Oct 07, 2008 -- Bank of America earns kudos over Countrywide settlement

If you're a regular listener, you know that Clark is no fan of Bank of America. But right now he's got to give them credit. As the owners of Countrywide, BoA has reached a settlement in 11 states where they'll offer workouts to 400,000 homeowners who were victims of predatory lending.

Mortgagees were put into loans they couldn't afford by Countrywide. Of course, you could argue, "Well, they were adults and signed on the dotted line. Why should they get a workout?" But who among really understands all the mortgage mumbo-jumbo you sign when you buy a home?

This collective workout will cost BoA between $8-9 billion. It will allow mortgagees to re-calculate their monthly payment to one-third their income. The 11 states affected include Arizona, California, Connecticut, Florida, Illinois, Iowa, Michigan, North Carolina, Ohio, Texas and Washington.

Meanwhile, there's another ongoing action where Countrywide allegedly cheated people by putting false fees on loans to create additional profits. That still has to go through the courts, so there's no telling when it will be resolved.

    I lost my job just over a year ago and my husband lost his job two months later. He has found a new job making just under half of his previous income and I have gone back to school to learn a new field. We have applied through the HOPE and multiple times through Countrywide, I even called my senators office and they sent a letter to Countrywide. We were sent an offer to roll the amount of our mortgage that we haven't been able to pay since Jan. 09, but no lowering the payment or interest rate. I don't want to use all of our savings and retirement to save a home that we may not be able to save in the long run. Any suggestions?

    I've never liked Bank of America, and the way they do business. Now I am in the middle of a loan modification with Countrywide and BOA takes over and cancels all programs in process. All of a sudden I'm screwed. What is a hard working person supposed to do?

    When we got our mortgage from B of A we were told that we would have the ability at any time to readjust the interest rate at no charge. A year later the rates went down and when we went in to adjust our rates, we were told that it would cost us $500. After much frustration and argument we paid the $500 and adjusted the rate on our mortgage....I just went in last week to find out about adjusting our rate and was told It would cost about $2,500-$3,000 to complete. I've called many times to work with them--they don't return calls. When I ask who I can call--believe it or not the answer is "I don't know"--this is a manager at our Redmond OR BofA. No further help. How can they offer one thing and just remove it willy nilly?
    B of A is a terrible bank to work with. We applied for a equity line of credit and they had to redo the app--THREE TIMES. And as owner of Countrywide mortgages (who helped us into this mortgage crisis) I hope they rot in a pile of their own doing.

    I bought a condo as a first time home owner in 2006. It was an APR with prepayment penalty for 3 years. The APR has caused me serious financial concern and payments have almost doubled. My mortgage broker at the time swore this was the best deal and told me all sorts of things that turned out not to be true. In Addition, Countrywide sold my personal information and told me in Nov 08 that I have been a victim of identity theft. I want out of my current loan as this is a huge rip off ("if I knew then what I know now...) I have been advised by a financial firm that they can renegotiate the terms of my loan into a 30 year fixed and my only fee to them would be $1500 if they could arrange a monthly payment I could afford. How do I know if this is a rip off too? I don't want to make the same mistake. Thank you.

    We applied for a streamllined mortgage from $1869 monthly and were waiting for notification of what new payments would be. Never Heard from countrywide except to tell us we were in foreclosure. Have been fighting for years to hold on to our home. Offered on Dec. 8, 2008- Pay $2239 for 3 months, then $1000 extra thereafter= total of $3239 per month. We can't husband is 69 year old redy to retire, I am disabled. What in Gods Name are we supposed to do. We are waiting to be evicted and homeless in our olden years.

    What about us? We are both senior citizens who have lived in our home the past 8 years -- and until a few months ago, have never been late on our mortgage payment. All our real estate holdings which we counted on to fund our retirement have now been foreclosed on (We exhausted all our savings paying all the mortgages to try and hold on). Now our only income is social security and one rental check from a tenant in our home. We are now almost three months in arrears on our mortgage and COUNTRYWIDE has been unwilling to renegotiate our interest rate. That's all we're asking for -- not a bailout! I don't understand why they would rather foreclose on our home than modify our mortgage. We've even consulted with a HUD approved counselor, and she's getting the same unsympathetic answer. Why can't the state of Georgia get the same help as other states in negotiating with mortgage companies such as COUNTRYWIDE? PLEASE HELP US BEFORE IT'S TOO LATE!

    I refinanced with a company 2 years ago and they sold the morgage to Countrywide. We have had some financial difficulty and Countrywide will not help in any way, not even change my due date. I so want to get away from Countrywide.

    I refinanced my house through Countrywide right before the bubble burst in Florida. I had recently left the military and needed to lower my monthly payment, so my morgage is a 5-1 ARM with interest-only payments. Therefore, I am gaining no equity back in my house, and I have a balloon payment to look forward to in under three years. I refinanced $190,000 using two mortgages at the time, and the house is now shown as being worth $145,000 online. I am able to make the payments as of right now, but I'm working against the clock before I can't afford them. I'm wondering what's my best course of action - wait and pray or try something else?

    My mortgage is through Countrywide. My husband has lost his job. It takes 2/3 of my income to pay the mortgage. Countrywide refused to recalculate my mortgage to something I could afford on my income while my husband looks for work/gets training for another career. BOA and Countryside still stink. PS...until now I have always been current on my mortgage.
