Sep 16, 2009 -- Banks trying to push people into variable interest rate cards

One of the great provisions of the Credit Card Holders Bill of Rights is that it will prevent interest rate hikes on existing balances when it becomes fully implemented by February 2010.

But the banks have found a loophole that you need to know about.

Be on the lookout for a notification about your credit card being switched from a fixed rate to a variable rate. Variable rate cards typically put the interest rate at the prime rate plus additional points.

The prime rate is low right now, which might give you a false sense of security. But as the economy recovers, it will likely rise -- even on your existing balances. And this is totally legal!

Estimates suggest that somewhere around three-fourths of all cards will become variable rate cards by February. People who run balances will most definitely be targeted.

But you don't have to take it. You can reject the notice of the change by certified mail. That will ensure there's no question that you properly notified your credit card issuer.

And if you're not running a balance and always pay in full, who cares what they do with the interest rate? The interest rate becomes irrelevant to you.

Finally, beware that some banks are now charging a monthly inactivity fee on cards that haven't been used for 12 months. That makes Clark's longstanding advice about using your "back of wallet" cards at least twice a year more important now than ever.

  • CHASE!! Bad Business! Changed Fixed APR of 6.9%
    They changed a fixed apr they had on a balance transfer offered. If I knew that the fixed apr would change I would have never took it.
    I mentioned to them that, I did not receive the change of terms in the mail, they increased my rate from fixed apr from 6.99 to 12.44%.

    No late payments, nothing like that, so I talked to a Manager today Gail, and told her that I would like to increase my payment instead of paying more interest, they told me that there is nothing they can work out.

    So closed my account today and will no longer be banking with them.

    Anyone thinking about using their fixed APR prmotions!! Please be aware!!

    This just happened to me today from Chase. I argued w/ the rep for 10 minutes as she lectured me that this hike was due to "the economy". I closed $25k in credit (I only had a $1700 balance). I cannot beleive that you would tell me to close my account because you raised my rate rather than leave it open, with the option for me to use the credit, and leave it the way it was! What am I missing? I am so glad to have to pay for the people that don't..."share the wealth" right.

    Yes you can reject the notice of change but they will close your account. This means that any points you have must be used within 90 day or you lose them. Well guess I will never by a GM car now.

    Ditto squared to all those of you who recommend paying off credit cards, using only debit cards/cash, and living within your means. Have long thought that the cc industry is evil in the way they enslave people to credit. Pay off your cc and control your destiny.

    I made the decision in 2002 to stop being jerked around by CC companies. After paying off my card, I closed the account and have been using a debit card ever since. That's why I marvel at how people are up in arms - just say no. The day you learn to start living within your means is the day you'll start down the road to freedom from what one writer called "legalized loan sharks"

    Mine has changed their rate from fixed to variable and according to them during a face-to-face meeting was told it was because of the government mandates they are under. I don't think so - just another way for the consumer to subsidize controlling their ruthlessness

    After looking at what others have said and my own disgust with credit companies I decided to burn my City Bank Card and have gone after the Cap One Card. The account management number I believe is
    1-800-889-9939 stay on the line and demand upper management. They may jack you around even when you tell them your rights and tell them its ok I’ll just close the account (may affect your credit score). Know your rights and what to say… I will continue to pay my account @ 83 a month.
    Once December Ill pay most of it off , than in January screw you Cap One all my payments will go to you.
    All $800 that week than F OFF.
    Even if your family needs to help a bit (ask for some funds) don’t let them get any of us with this shit in 2010!!

    cash ... and more of it since I don't give it to the Credit Companies! They get enough of my earned "share" everytime I use my debit card, no need to give them more with a simple "signature." Setting your own rules to comply with ... "priceless."

    The answer is simple... GET YOUR CREDIT CARD FROM YOUR CREDIT UNION. Credit Unions have lower fees and lower rates. Banks are evil.

    I think it should be "...becomes fully implemented by February 2010" with emphasis on 2010, not 2009.

    My notice, as of 9.11.09 says I can reject the changes, but they will close my account and allow me to pay down any balance over a period of time. Ok, but how does this impact my credit score IF they close it because I rejected THEIR changes?

    only a fool borrows money when the lender as the legal right to change the terms of the loan or interest rate on a whim. why not just suck it up, live frugally for as long as it takes and pay the credit cards off and then..who cares what the credit cards charge for interest rates? you will be paying them 100% of nothing.

    Clark I didn't see you mention that by refusing to accept the change in terms your account will be canceled after your current balance is paid off. Has this changed? Any change in terms can be rejected however it will result in your account being closed.

    Clark says that this is a "loophole." But I think that instead of being a loophole, it was planned by the "Banksters" and their congressional henchmen so the they could pretend to "protect" you while at the same time they were planning to fleece you!
  • Cards are fine if managed properly. Sounds kind of dangerous to be taking a lot of cash out of the atm and trying to carry it around. Don't let the gangsta's see you doing that.

    credit card issuers are LEGALIZED LOAN SHARKS! They may not break your knee caps, but they can ruin your life!

    I've been on an all-cash basis for years, and it's really the best way to go. I don't even write checks anymore. As for these thieving Credit Card companies, my best advice to you all is to FIRE THEM. Stop relying on bank loans for lunch, fuel and the occasional goodie that can be paid for using Cash American Money instead. Make friends with your ATM! Draw enough cash weekly to meet your expenses and put the credit cards away for GOOD.

    If you run a balance, get out from under it. Make a plan: cut the darned things up and make the decision to pay it off as quickly as possible. Then (the hard part!) --stay debt free, forever. This is the only true way to a good night's sleep. YOU CAN DO IT! I'm 6 weeks away from being totally debt-free myself, and trust me, the wife and I will be partying ALL NIGHT LONG when it happens!!!

    The days of legalized loan sharking to weak-willed people are OVER! Face it folks: banks don't care if you live or die. Getting into your wallet is all they care about. SACK THEM ALL.

    Cedit Card, belong to the issuer, they can do what they want, you have two choices, keep the card and take what ever they dish out, or get rid of the card, thats it, final, period. If and when things turn around and they come looking for customers again, then the ball is in your court, and don't forget how they treated you.

    I got my notice in the mail for my Bank of America card. They switched my card to a variable, I rejected the change, but they said "Too bad, you can't reject it". I filed a complaint with the office of the currency comptroller, and got a letter from BoA, stating the samething.

    I agree completely with the previous comment. this should be a big wake up call to all Americans NOT to let credit cards dictate our lives. Pay them off, stop using them and then none of this is relevant. Keep one, pay it off every week and all bases are covered!

    My goal is to live a cash lifestyle from now on, and once balances are off the card, to never depend on one again. Because of these practices by credit card companies. They are legal loan sharks. No loyalty to existing excellent credit customers, regardless of payment history. American Express has been the worst offender. Will never use it again.
