Jul 17, 2009 -- SEC cracks down on another free-lunch seminar group

RIP-OFF ALERT: The Securities and Exchange Commission has taken action against Prime Capital Services for allegedly operating free-lunch seminars designed to sell variable annuities to senior citizens.

In general, free-lunch seminars are extremely popular in Arizona, Florida and Nevada. Seniors in their late 70s to late 80s are usually targeted. During the event, a charming salesperson will typically come up to them and offer to schedule a free private consultation where the real sales pitch comes.

"[PCS] used free lunches as the low-tech bait for their high-scale scheme," according to a statement from the SEC. "These con men lured elderly and retired investors into purchasing highly unsuitable variable annuities, enriching themselves with commissions while ignoring the financial goals of their victims."

In other words, they get rich and your parents (or you) get poor.

Money put into a variable annuity is generally not accessible without penalty until 10 years after the origination date. That makes no sense for a senior who needs to be able to spend their money. If you ever get a free-lunch pitch, you should run the other way.

Remember, the most expensive meal you can ever have is a free one. It will result in the biggest case of indigestion you could ever have.

  • Free-dinner seminar
    We unknowingly went to one of these events. The advisor told us he was a "fee-only" advisor. We scheduled an appointment and he did tell us we needed an annuity so my husband could retire. When business was completed and we asked him what we own him, he said he was paid through the annuity company. Do we have any recourse??

    When I get these invitations, I call the hotel/restaurant and find out the menu and the amount of time the conference room is booked. Sometimes, there's only a soft drink and cookies. If I like the menu and the facility is booked for two hours, I might accept. Leave checkbook and credit card at home!

    For another take on this subject, I would direct you to today's Wall Street Journal for an article in the Personal Journal section entitled "Long Derided, This Investment Now Looks Wise. Where else can you invest your hard-earned savings in order to ensure you can have a comfortable retirement that you cannot outlive?

    annuities are WRONG investments for anyone except the salesman in my opinion. Insurance =income for the company-when did an insurance company GLADLY pay out anything? Old people nee dmonthly income-CD's T Bill, T Notes & Bonds and Munis are what they need. Not annuities.

    Clark is wrong again,,,Clark has 45 secs to i minute to make a point. He can't explain in depth investments that could be just what a senior needs. Again thats for some, not all. Never forget Clark is a BOOK SELLER, nothing wrong with that, just say what you are..

    I go to every one of these I can for the free food. Just don't sign or buy ANYTHING. Eat and leave, that's my motto.
  • Can't believe people still go to them!
    They were all the rage in the 1970's, especially if you lived in a tourist town. I went with a very ex boyfriend, he got roped into it in Tahoe. But, when they found out he didn't have a job, they immediately dropped trying to pitch to him, but they also found out, that "I" had a career, and turned their attentions to me. My family has a very long history of very high end real estate so, they wouldn't going to sell to me. The standard story here, the guy giving the pitch got madder and madder, when he couldn't sell to me. The cost, any amount they could get out of me down, and $99.00 a month for my time share! They basically, through us both out of the seminar room, when I disclosed the family business, and the fact we already owned several vacation homes in the same area they were pitching to me: Vegas, Tahoe, Reno and Hawaii.

    sounds like these folks are taking lessons from the scam artists who sell timeshares - went to a timeshare presentation when I was much younger, it was the closest I ever have been at physically striking a salesperson. That was 20 years ago and I have never been to another timeshare presentation again.
  • Any One Remember Cal Spa Stores from the 1990's?
    Cal Spas use to trap people who wandered into one of their sprial stores. The moved people from room to room, and passed them off to new salesmen to keep a person in the store until they wore you out, and high pressured you into a purchase.

    The store was spiral shaped, so you only had one door into the store, but couldn't easily turn around and leave. Nor, you couldn't find an exit if you had had enough of the pitch.

    I went with a friend--Libby Clovis--we were trapped for 3 hours in this place. Later, the Attorney's General's office of Californis shut them down.

    Clark, warn your readers and listeners that this happens at all levels of sales!!

    My wife's grandparents got the free lunch speech at a local car dealership while waiting in the service department lobby, when bringing their car in for repairs. The salesman came up to them and started talking about their van and how they had a newer one in the lot, etc. He kept them there for hours, took them to a local McDonalds for lunch and even followed them back to their house to get a check for the trade difference. Not only did they buy a repair nightmare they overpaid for the vehicle by $10,000.00. I'll never do business at Suncoast Chrysler Jeep at 8755 Park Boulevard Seminole, Florida 33777!!

    I went back the next day to return the vehicle and discuss with the service manager who brushed me off and said they wouldn't return the money and, “felt comfortable with the deal”.

    Unfortunately my wife's grandfather had more money than patience and didn't want to deal with a complaint or lawsuit.
