May 22, 2009 -- How GM/Chrysler bankruptcy affects you

It appears certain that General Motors is going bankrupt. The government was hoping to keep GM afloat with a private workout, but they're running out of time and it's unlikely that will happen now. Since we've already sent them over 30 billion in bailout money, the question remains as to who will assume control of the bankrupt company -- the government or the debt-holders. Either way, stock holders and bond holders will lose.

What if you own a GM or Chrysler car? The good news is the feds have agreed to back the existing warrantees for both, as well as the dealers' extended-service contracts. The bad news: some of you who traded in a car that still had an outstanding loan may face a problem. Dealers who are going bankrupt are not always paying off the loan on your old car as agreed. Unfortunately, that leaves you responsible to pay off both loans, even though you traded it in.

Another problem with these dealer closings is loss of your service records. Warrantee agreements rely on these records to determine whether owners are doing the required recommended maintenance. Without them, claims can't be processed.

What does this mean for you? In this market, Clark advises you to not to trade in a car that still has a loan. Also: if you don't have all your service records -- and your dealer is still in business -- go to the dealership, request copies of all your records and file those away. On the plus side, if you're a buyer, inventory overstock will allow you to steal a deal! But you'll need to buy with the intent of keeping the car a long time -- ten years or so -- since your car will have little to no value in the used-car market.

    Sence the Chrysler went backrupt they will not fix my 2008 truck at the dealer that I bought it at. I have turned it over to the Lemon Law but they only ofered me $4200.00 for a $52,000 truck. Wish I could get more help .

    Do you owne a GM car or truck? I would bet not. Did you know GM has out sold every other manufacturer in the US this year. You should talk about that not try to tear down one of this countries last Icons. I thought you where better than all the rest. I was wrong.

    Having read some of the comments about the auto companies It is my view that folks just don't get it. Sure the unions are a greedy destructive influence but so is blotted ineffectual management. However the problem runs even deeper. We are being out performed by a significant amount on the engineering side.. While we graduate so few engineers and pay them on graduation 1/3rd of what is starting money for attorneys and the financial management super stars who got us into this mess what can one expect. Sorry folks but the problems run way deeper than unions long time dealer contracts etc.. We are getting thrashed at the design desk, cad screen or what ever.
    The autos are likely only a symptom of the emphasis being placed in the wrong place and to correct that will require a significantly longer fix than a few bail outs..

    Dave, in an idealistic world the bankruptcy would work to remove the stranglehold the unions have on the car industry. Unfortunately part of the bankruptcy is going to involve handing over the majority of the company to the UAW, just like with Chrysler.
  • From the beginning the government should have let GM fail. Nobody is too big to fail. It would have given our system a chance to work the way it should as someone would have filled the void. But NOOO, not our govt. They have to screw things up once again. I feel sorry for anyone who has a newer GM vehicle. Those poor people have to look to the govt. to cover their warranties.

    Hopefully some good will come out of this....GM and Chrysler will have a chance to get rid of the unions that strangle car manufacturers...they get paid 6 figures to watch a robot weld, they stand around and unpack boxes of parts that are made in Mexico, but installed here. half of the plastic crap they put in cars nowadays is made by cheap labor in other countries, then put on the car here by a overpaid union worker....the unions had their place in 1930's-1940's America to make sure the workers rights were not stomped on by big companies, but now they are nothing more than a financial drag on the companies that use union workers...they have to raise prices on their products to pay outrageous saleries, pensions, and benefits packages....extorted by the unions...whose motto is give us more every year or we strike. The major auto makers have could sell their products for half the price if they didn't have union workers...I would work an assembly line job for half their wage, with minimum insurance, and no pension package...and be happy about it. Then maybe they could sell cars for 10k-15k instead of 25k-30k. I would rather buy a fully restored, older hot rod for 15k, than some of the plastic, union made, crap they sell for twice the price nowadays....look at this as a blessing. If they can restructure without unions and make cars, that people want (electric, hybrid, fuel efficient) cheaper (so you don't need to take out a 10 year loan to pay for it)....they might wind up out-selling and out-profiting the other car companies.
  • What a surprise. The bailouts were a complete theft and waste of hard working people's money. Why did 99.9% of the US population know these auto bailouts would be a compelte faliure while the idiotic govermnent thought it was a good idea?

    It's about time GM had the nipple turned off. I am tired of the chosen few eating away at my tax money. They had decades to get it right and couldn't. I will drive my 10 year old Infinity til it falls completely apart which may be 10 more years.
