May 22, 2009 -- Complaints about debt-settlement firms on the rise

Have you seen ads being run by the debt-settlement outfits on late-night TV? They promise to reduce your credit card debt to just pennies on the dollar without making you file for bankruptcy.

But that promise is an illusion. Here's the scoop: You usually pay an upfront fee to the debt-settlement firm, plus a monthly retainer. Their strategy is to get you to stop paying on your bills. They typically have you take the money you would have paid on monthly minimums and stash it in a savings account.

The basic idea is to make the credit card companies so desperate that they'll settle with you. The reality, however, is that you just wind up damaging your credit.

In fact, complaints about debt-settlement firms have doubled in North Carolina; tripled in Florida; and quadrupled in Oregon, according to The New York Times.

The reason these companies even exist goes back to 2005 when the bankruptcy laws changed in our nation. At that point, the banks stopped being cooperative with affiliates of the National Foundation for Credit Counseling (NFCC). They were cynically trying to force people into a position where they had no choice other than to pay up. The debt-settlement firms then popped up promising they knew how to defeat the banks.

The irony here is that the banks have now agreed to work with the NFCC again. A newly announced debt-management initiative offers reduced interest rates and the possibility to waive your late fees.

    My husband and I appox 4 years ago talked to a company on lowering are payments on our credit cards. They didn"t tell us it would hurt our credit. We were not behind on payments, we thought it would help, because we were sale one house and going to buy and another. Two month later on my husbands credit report, the credit people cancelled all credit cards and wrote it on his credit report and damaged his credit. To this day it is still on there.

    For people who cant make monthly payments, then the strategy for Debt Settlement consultants can not be for that client to stop making the payments. They cant do it already! There are good debt settlement companies out there. If the client enrolls into a program with a company he or she knows nothing about, then it is that persons fault if they get their fingers burnt. Problem is people believe too much what others say and refuse to face the reality of their situation. And when you tell them the truth, when you tell them everything that could happen in the program(lawsuits, judgements, obviously credit problems and harassment) they may not enroll because it doesnt sound good. People refuse to face reality, they seem to think that they can handle the situation without damaging credit or recieving phone calls. Basically wanting something that doesnt exist. And publishing ignorant articles like this one is premature and stupid. If you dont have all of the facts you should never be definitive in what you say.
  • I disagree with Clark Howard.
    Clark got this one wrong. Debt settlement companies were popular long before the changes in bankruptcy law. People who enter debt settlement programs cannot afford the minimum payments on their credit card debt or credit counseling programs. Debt Settlement is their only option other than bankruptcy. The reality is that debt settlement has worked for millions of people, and if it didn't, the FTC whould have shut the doors on debt settlement companies long ago.     Not ALL of us suffering in this debt black hold got here because we over spent...sometimes a SPOUSE over spent and WE got stuck with it in the divorce....what am I supposed to do to get rid of it?!?!? Sometimes people just get SCAMMED....and there's not a darn thing we can do about it because the courts say...what's HIS IS YOURS. So quit slamming people without walking in their shoes. Sometimes divorce comes too late. The damage is done and by the time you figure it out...you're screwed.

    I recently read an article in the New York Times suggesting debt settlement as a viable option. As long as you go with a reputable debt settlement agency that is. I successfully graduated a debt settlement program 2 months ago. I had $25,000 in credit card debt and all in all ended up paying back $14,250 including fees! People, if you have debt you can go with a settlement company and have success, just do your homework first!

    Didn't you forget, we all got in to this mess after this national financial crises, most of lost our job closed our business and have no incom and yet we do have family to support and bills to pay, HOW ARE WE GOING TO MAKE IT, so let us stop bleming each other and point our finger on others insted let us try to find ways to get out of this financial mess that we are in now, i don't think no one wants to fall behaind payments without having any finacial difficulties.Do you?

    I agree there's an add for debt settlement no only on this page but in most of his radio shows. Why allow these ads during The clark Howard Show and why allow them on the web site? Loses a little respect to me?!?!

    You do realize that Washington spends more money annually than they bring in... right? You think they have the answer for wise and rational credit standards?

    If you had a printing press in your basement, you'd look like a monetary genius too - just print your way out of debt each month. Oh, if it was only that simple.

    after reading many of these posts on clark's site about the pitiful people who just keep digging themselves deeper and deeper into debt and for some unknown reason, just do not seem to know why.
    I can only surmise that there are some people who are just to stupid to have access to credit. These individuals will stumble thru their entire life going from one financial catastrophe to another and still not learn the one and only thing they needed to learn:
    to get out of debt one needs to spend less than you earn.
    There you have it...and entirely for free.

    With all due respect MRN, I do not think everyone who owes money is a deadbeat. My point is that you need to pay attention to your finances and adjust accordingly. If you are paying more than the minimum on your cards, there is no way you should be falling behind unless you are late on your payments. Overdraft fees come from your bank, not the credit card companies. If you pay your bill online or via an echeck, you authorize that payment. The bank pays the credit company and charges you if you don't have the funds.

    Look, I owe money too. But I don't expect the feds or anyone to just give me a handout to eliminate my debt. I made the purchases and I am liable for them, period.

    If you can prove you've never overdrawn your account, then you should be talking to your bank, not the credit company. They got paid by the bank, not you.

    I agree with Madeline, I pay on time and more than the minimum and I still get deeper in debt. This whole program is just cruel. I don't agree that Clark is in it for the rich, I just think Washington should stop this nonsense so that we can get out of debt. As opposed to Rob who thinks everyone in trouble is a deadbeat, I am the classic example of a person being beaten down by Credit Card Companies. Since January of this year I have paid $3,877 on my Chase Credit Card. They charged me fees of $1,679 plus they charged me $3,088 in overdraft fees from my checking account. I never authorized them to attach this to my Checking account and I haven't overdrawn my checking account since I was a youngster. I can prove all of this but they don't care. The only resolution is legal and I have no funds for an attorney.

    I have tried calling you for help, emailing you, etc. I have tried everything I know. I tried to refinance my home and they wouldn't. It is only getting worse Why if you are so good can't I get any help or advice from you. You seem to only help people with money. I am going to call again Monday and see if your people can help me figure out how to pay a card I pay every month and still owe the same amount I owed last year at the same time.
