Mar 27, 2009 -- New findings on how the giant monster mega-banks rip you off

RIP-OFF ALERT: USA TODAY has done some new research into how the giant monster mega-banks rip you off.

This should be of special interest to customers of Bank of America, Chase, Citigroup, Wells Fargo, HSBC, PNC, U.S. Bancorp, SunTrust and others. Here's a quick rundown of the newspaper's findings:

• All the banks allow you to overdraw at the ATM -- except Citibank.
• All the banks allow you to overdraw online.
• All the banks allow you to overdraw at the register -- except Citibank.
• The majority of the banks won't even give you a warning at the ATM to deter overdraft.

Bank of America recently settled a class action lawsuit over their overdraft fees. It turns out they had software to calculate how to generate the most overdraft fees when a customer went negative on his or her account.

A typical overdraft fee at most banks could easily be $35.

This is the game the giant monster mega-banks play. So it's incumbent on you to do a few things. First, you can take your business to a credit union or smaller community bank instead. Second, you can continually monitor your account online to make sure you're in the black. Third, you can use a bank register to track your account to the penny.

Don't let the banks play Jesse James with your money. The real irony here is that at least 3 of these banks -- Bank of America, Chase and Citi -- are like pigs lining up at the trough of federal bailout money from we the taxpayers.

And this is how they turn around and thank us?!

Meanwhile, to add insult to injury, Chase had been planning on buying 2 private jets at $60 million a piece, and wanted to spend $18 million to dress up an airplane hangar, according to a TV news report Clark saw. Chase has now agreed to delay these purchases until they pay taxpayers back.

Finally, senior producer Kim brought some perspective to the USA TODAY article by explaining how ING Direct went above and beyond when she nearly overdrew her account. Talk about great customer service!

    Yesterday I had $5.00 left in my account after BOFA reversed a charge they gave me credit for. They said they never received my letter which also mailed as well as faxed to them. They took over $105.00 and caused everything purchased previous to that to bounce. $140 in insufficient funds fees in one day. In one week that will escalate as I have not the funds to cover it.
  • Another BOA Scam (Overdraft Protection!)
    Hey, I just got hit with a different kind of overdraft fee! I signed up for their "overdraft" protection, linking my account to my BOA credit card after that last fiasco. So, the deal is.. when you overdraft with your checking, they take the remaining balance off of your credit card and charge $5. I thought, hey this is great! This is just a credit card charge for things that would otherwise be a checking account charge.. cool. Well, what they do, is when you go any amount over the limit, they transfer your ENTIRE remaining credit balance to your checking account. That maxes out your ccredit card instantly, while putting cash in your bank. Great, ok.. 1st time this happened, i just sent what I didnt need straight back to my credit card account. The second time this happened, I noticed it a couple of days after the fact, (but before statement date), and sent money back to my credit card (so that it wouldn't be over the limit). I still got hit with a $35 over-the-limit fee on my credit card due to their shenanigans (because I was $5 over the limit due to their unnecessary transfer of my entire credit balance plus adding the fee after the transfer!!!). If you sign up for their overdraft protection and link to your credit card, anytime overdraft protection is used, your credit card will go over the limit, every time! I think the only way to avoid this is to catch it same day and put the $5 back before they end their transaction day. Anyway.. yet more very unnecessary charges.

    Hey Be Responsible person, have you read nothing anyone is saying? For the most part, this isn't about writing bad checks. Most overdrafting isn't even done with checks, it's done with debit cards where the bank has a chance to reject the charge at point of transaction anyway. The bank chooses to extend credit to people, but it is not at all treated like the loan that it is. If the banks really thought overdrafting by a client was a crook thing, they wouldn't allow it. For people with low balances, overdrafting occurs even when there is money deposited to the bank account that would cover the transactions, but due to radically differing transaction schedules, overdrafts are sometimes created where they are not necessary. The poor often do not get the luxury of waiting 3 days to have access to their money anyway, and I've personally had automatic bill pays come out on days I wasn't expecting (wasn't the same day it came out the month before at all!!) and causing overdrafts.

    Amen to clearing transactions in order. I am through with these GOOBERS. I have good credit but have fallen on some bad times - the F...... Pepsi at Publix cost me $35.
  • Banking Rip Off
    What ever happen to clearing a transaction in the order it was charged? Why clear from high to low transactions? Because of the fees the banks can charge. I bank with Wachovia and have been a victim of this as well. I even had my payroll checks post after midnight but to only have the bank clear my transactions first, putting me in a negative balance before crediting my account with my payroll check. When I asked why, I was told the payroll check is cleared at the time determined by the employer. What ever.... I then stop automatic deposits and picked up my check from work. This wasn't working since I live far from where I work. Now,I have opened up a new account elsewhere for direct deposit purposes only, and withdraw all my money on the next day, leaving only $10 in each account. I don't use my debit card anymore. All bills are paid in cash, in person or money order. A few cents for a money order is a lot cheeper than several hundred dollars. Yes it's an old fashion way of paying bills, but it works and saves money.

    They ripped us off for the last time. Its now time to slowly get some revenge! My account is free, so I will leave it open...forever! BUT.... I will continue to direct deposit my check, then I will transfer my money to my new Credit Union account. Then several times I will make a $5 deposit and the next business day I will withdraw the $5. BOA will have to send me PAPER through the mail each month showing me my transactions. The mailing fees they incur will make me smile each month!I will never keep any money in BOA but they will still have to, customer service me daily! For several years I will get pleasure from this little game. Maybe even requesting tons of information from them but never signing on to nothing.... REVERSE HARASSMENT! (GRIN)

    I love all of the perfect people commenting about balancing accounts, keeping registers, etc. I work in the financial field. People, please remember, **** happens and it can also happen to you no matter how perfect you are. Do not call people names and speak down or ugly to them. One day you may find yourself at the bottom. Many rich, perfect people have committed suicide when they saw their millions disappear because they could not stand to be at the bottom. Make sure you never take for granted that you could not be there tomorrow.

    BOA is not the only one. I have been fighting with Branch Banking and Trust for years. I even had them charge me $70 in overdraft fees because they did not post my cash transfer from my savings (w/ $7000.00 balance) to my checking on the same business day that I made it just because I did it at an ATM after 4PM instead of online where I would have had until 9PM.

    Looking at how BOA does overdrafting, it is not enough to keep track of your money online and how much you spent and deposited on paper, because each different type of transaction is processed in a different timeframe and they rearrange it all to max advantage for themselves. Furthermore, They don't show you they are doing this or just what is going on with online banking, ATM, or by phone. The following is taken from my online banking, the first one being most recent one they processed. It shows the transaction, then the available balance. Please note that my available balance went straight from $85.45 to two overdraft charges, which I didn't know about right away so used my card again. Please note that without them, I had the funds there in order to cover the charges. I will also be charged one more $35 fee after that for the last transaction. As they put it, they overdrafted me because my deposit(that as you can see added to my available balance) was not in fact "available" yet. No they will not refund these fees, I have tried. So really, it's not just lazy people not keeping track of their spending or people purposefully overspending, the rearrangement of transactions is predatory.

  • BB&T OD charges
    BB&T says I OD my account by $98 last week. They want me to repay them $441!! I think that's about 350% interest in a 24 hour period!!!

    Pawns shops and Title loan companies can't even charge that much, how do that get away with that??

    Can someone please tell me if and what recourse we have for this?? Need help!!
  • Bank Account Alerts SCAM
    B of A has had my personal checking, and a couple of credit cards for years. I've been happy until now. I took their word for it, like a fool, and signed up for the Alert Notifications, which are to alert me to all sorts of things, but the main ones I selected, and never expected to need were low balance threshold which I set at $100, and and transactions over a certain amount.

    Over the last two days, Using my ATM Card (which should be rejected if my balance is too low to cover a charge by the way) I racked up 7 $35.00 overdraft charges, and received not a single alert! I have a record, screen shot of the alert notifications history, which clearly shows none were sent, and I talked with B of A, and a supervisor who both agreed I was signed up for these notifications. Their SALES PITCH is "PEACE of MIND", that their Online Banking alerts keep you “COMPLETELY AWARE OF YOUR FINANCIAL ACTIVITY – THEY ARE FREE, AND THERE ARE DOZENS TO CHOOSE FROM”. We automatically notify you"..... it is sold to provide peace of mind, because we are so busy. The idea is to hook us into having the alerts, and then not notify us, and not notify that the alerts aren't working, or mail us anything to let us know, and collect these fees as fast as they can. They reimbursed me $61 dollars of $245. I suppose I raised quite a ruckus; told them I'd leave the bank, that this was a manipulative tool, sold to us to notify us rather than us proactively managing the account. It is a complete failure, and won't help anyone be aware of false activity, much less, an unusual charge that may have been overlooked; and takes full advantage of their allowing an ATM purchase with a debit card, even when they are charging overdrafts and you have dipped below the "$0 balance. BEWARE -- THIS IS A TRICK OFFERING.
  • BOA - Credit Card Fraud issue on 2-Cards
    A few years ago, I had 2-cards backed by BOA and decided to pay off the balance, as I had recently received a bonus at work. I called the 800# on each card to get the latest balance and was not able to pull my acocounts. A "faud" person came on the line and advised my address didn't match (for both cards) and scarier yet, my SSN had been changed on one account. I found out my addresses had been changed to Lot#'s in New Jersey. How did someone change my address and a SSN# and I was never alerted or sent a notice of an account change?? I had take a couple hours of my time to go into a BOA in person with my DL, birth cert, SSN# and a utility bill in order to prove I am "me". Once my identity was established as valid, I paid off both accounts and closed the cards. The bank personnel could not figure out why I would close the accounts and begged me to reconsider. Not a chance, ever!

    I agree with all the people who got ripped off. These banks are truly doing all they can to take your money for any way they can. I am the victim in every bank in my neighborhood. I have no respect for the banking industry anymore. The people should all get together and just drop all their banks, and get other forms of doing business. As for all you twerps who side with the banks, just because you have stocks in the banks doesn't give you any more clout then the banks. You are nothing more then a worldly bunch of thief's waiting for the next little man to run your scams on. That's right, you are just as guilty of theft by siding with them and probably are in the system you call finance. Crooks all of them, that's what banks are. They let scammers bill your account every month unauthorized and then have the nerve to charge you overdraft fees after your account is cleaned out. This is called in my book a scam in itself. But the Government we vote in does nothing to change the way banks get their money from innocent poor hardworking people who are forced to do business with banks because business cant be done unless we give them the knife to slit our throats with. There are people who just take advantage of others I sure, but to place good people in this catagory is sinful. We have been wronged, and even tried to fix the problem but the banks will not cooperate and take more money from us, even when we were wiped out, and punished for using the very banks that want more money from taxpayers to bail them out? Where the Hell did all their money go? Over spending their means maybe? I think so. So would you if you know all the tricks the banks are using to take your money without you even knowing they scabbing your account. Don't accuse me of being a poor bookeeper when you can plainly see where all the banks can't even prove their spending is constitutional. This was your money they retire with several million dollars a month with.

    To Ramguy: I don't care what the bank did to you, or whether or not the overdraft charge was your fault, their fault, or the fault of the man in the moon. If I was that banker and you threatened to "stomp a mudhole" in me, I would have had you arrested on the spot. If you can't handle your own situations without resorting to violence, let your lawyer do your talking in the future.

    I went to cash a check for $100 made out to me on from a friends bank account at Bank of America. Because I didn't have an account there, they wanted to charge me a $10 fee even though it was drawn on THEIR bank! What a ripoff! Needles to say, I went to my own bank and was charged nothing.

    I have banked with BOA since 1976 and they are the greatest. My husband and I both have used many of their services and never had a problem of any kind. Their staff is very professional and their system on line is very user friendly. If you handle your money in a responsible way you should never have any problem with any bank. Communication is a very important part of any business transaction.
  • Pay attention
    I think the big problem is that people don't pay attention to their accounts. I don't think it is the banks responsibility to babysit how much money you have in your account. It's a responsibility issue. I keep a ledger of my accounts and know to the penny how much I have at any given time. I do use online banking and check my ledger against it regularly. I don't think the banks should be blamed for a person neglect when it comes to how much money they have in the bank. If you don't care enough about your money to know what you have, how can you complain about what the bank does. Why should the bank notify you that you are spending more than you have? I believe the real problem is people don't live within their means. My dad taught me not to spend more than I make. If people today lived by that, there wouldn't be any problems with these banks. I don't think its the banks responsibility to track your money. Its your money, you should know what you have and take care of what you have.

    I love USAA bank. They are very friendly and courteous whenever I call. I have been slowly weaning myself from Bank of America to USAA. They have made the transition so much nicer. I also have an ING direct savings account. They have wonderful offers too.

    Not all overdraft fees are the fault of the account holder - bank employees are human and everyone makes mistakes. My husband works for a bank and has no problem refunding overdraft fees if it is a bank error.

    I totally agree with the person who praised USAA Bank. I've been dealing with USAA for decades. They are fantastic: great service, honest, and efficient. I also use USAA for investing- first class on everything!
  • Wachovia may not be so bad.
    I have a Wachovia Visa which is linked to two checking accounts we have with Wachovia. I have not had an overdraft in many years, but recently caused one, due to my own oversight. I had used one of my old Visa cards which I don't normally use, and had forgotten that this card automatically debits my checking account for payment. At the same time I had a mortgage payment debiting from the same checking account, which resulted in an overdraft. Luckily, the Wachovia Visa is set up to handle overdrafts, at a $5 fee. Five dollars is a deal compared with what I may have paid for a late mortgage payment, a late credit card payment, and any other bank overdraft fee that could have been charged. In this instance, Clark generalizes too much, harshing on Wachovia.

    I once had a mortgage with Chase. Had being the key word as it's been a few years now. It took them almost a year to get my address right. At the same time I was getting mail at my correct address from them wanting to by the mortgage at this particular piece of property. Finally I called them and told them I was ready to let them buy it. After being transferred around and being put on hold a voice on their side said, ahhhhhhhhh we already have a mortage on this property. I said yeah I know. I just laughed and hung up.
  • Chase is THE worst
    Mom had been banking at Chase for almost 70 years before she died. A couple of years before she passed away she went there to have an account changed to add my name as co-owner. As I could not make it that day, the people at the bank, who knew her intentions very well, convinced her to open the account IN TRUST for me instead of putting the funds into her checking account until I could get there the next week. After she passed away I had to go through hell to get the funds. Also, a couple of months after she passed away I went to one of the branch offices to have the address changed so that statements would go to my address. NOTHING EVER CAME TO ME even though I was listed as co-owner of most of the accounts.When I finally withrew all the funds, I did NOT get a detailed accounting of every account. I guess our attorney will have to handle that.
    And Chase bought out WaMu but could not access her account there.
    I will not bank with them again, that's for sure.
  • BoA is the worst
    Bank of America is the worst. Finally weaned myself in February, 2009. Story is too long, but is a compilation of many on here, not late fees, but one sided changes in terms of banking relationship disclosed on the web site, as if anyone looks through every page on a web site for possible changes. They couldn't/wouldn't tell me when the change took effect, or how I was notified. Said it was sent in a statement and said a copy was enclosed with a letter they wrote, but alas, there was NO enclosure! Best description: incompetent, inept, ignorant, arrogant. No better results even after I wrote the President.

    I love my ING account - they give me a $5,000 overdraft credit line. When I use it, there is no fee, nothing. All I do is pay 8% APY on what I borrowed. It usually turns out to be about $.01. Beat that for an overdraft fee!

    Why do you spend so much time defending people who are so dumb and lazy they do not keep up with how much money they have or do not have in their accounts? I like to see high overdraft fees. That means the banks make their profit from dummies and the banks leave me alone for a free ride. Just let the dummies keep paying, otherwise those of us who pay attention will wind up paying for the dummies.

  • Maybe The Old Fashioned Way Works
    I use a couple different banks. I try to keep a fairly large balance in both. One of my renters uses one of the same banks. I deposited the rent check one day and to make sure I asked the teller to make sure that since the my renters check was from the same bank that the money would go into my account immediately (it always has in the past). She assured me it would. I was buying a used car later that day and decided I would use that my account at that bank to make the purchase. A few days later I got a letter saying the account was overdrawn. It seems the teller got lazy and some how the renter's check didn't go in until the next day. They admitted that was what happened but said they couldn't do anything about it. I talked to some mealy mouthed manager and just refused to do anything. As it happened I saw him again the next day at a little out of the way restaurant. I know I shouldn't have did it but I was so furious I just walked up to him at his table and said you know me don't you? He said yes. I said good because if he didn't take the charges off my account I was going to stomp a mudhole in him. The charges were removed that day. I wouldn't recommend this approach but it seems that is what this is all going to come down to.

    I have recieved over drafts from wachovia too many times because they (wachovia)decided how to pay my checks. their system is to pay the largest check first even if two smaller ones come in at the same time. so if you are over drawn, they collect two over drawn fees instead of one. when i protested this they gave me one of the overdraft fees back but that was after if figured out what they were doing. it is important that we print out a copy of your transactions because they have gone into my account and changed it around so that when i went back to prove what happened they had rearranged the transactions. I am not making this up I have lost as much as 200.00 in over draft fees because of this practice.
  • Chase Attitude on behlf of my father's estate
    As power of attorney(POA),I went to Chase bank with my father to have my father's address changed and become POA on my father's estate account. I faxed the estate and POA paperwork to the bank in advance and set up an appontment to change records. When I arrived not ony did I have to wait 45 minutes but was asked as POA as daughter if I wrote this up myself. NOT it was done bt an attorney as signed o the paperwork! I could not belive the attitude of the staff. I live near the branch I attended and my father is from the inner city as displayed on his trust paperwork...hence the comment. I will never go to chase again and worry now worry that chase owns my WAMU credit card that I have to find a way out fast. I was always polite in face but man even the branch employees need a jolt of reality. I am moving my father's money asap.

    I made LARGE payment on my balance. I usually pay it off, but taxes were due. I also always pay early, but this time I was one day early and it fell into the previous months statement and was charged a $39 late for a missed $29 payment. I called to complain, but they wouldn’t reverse it. I told them I wanted to speak to their supervisor. You can’t do that sir, but we will have them call you within three business days. I requested a call twice no less. It’s been over three business days and no call! This is new for me, they don’t let you talk to anyone of authority. I’m dumping Chase.
  • Overdrafts are the account holders fault
    Give me a break. It is always someone elses fault for our irresponsible behavior. Simple- most of the mess our country is in ie: housing is because the homeowner acted irresponsibly. Same with over drafts-be responsible for your own money and what you have where and you'll never even have to think about overdraft worries. Come people be adults and act like a responsible one and all this overdraft non-sense will not ever be a thought for you. It is up to YOU.
  • It's real easy for a lot of you to sit behind your computer and berate so many people who are victimized by the banks. You sit on your thousands of dollars, forgetting that your neighbors, your church members, your co-workers may have lost their job, may have developed a medical condition, may be going through a divorce, etc.

    And the best you can do is blame THEM?

    It's been proven that the banks have tried their best to extract as much income out of regular people for YEARS. Gone are the days when people respected each other, when you could make deals with just a handshake and a smile. I'm more disappointed at the lack of empathy from you poor excuse for Americans. Sure, some people DO try to circumvent and take advantage of the system every chance they get. But there are so many others who are getting beaten while they are already down. I hope you people and the banks all meet with the same fate -- going straight to a place not suitable to mention here.

    I love ING! Also, my local bank is great, real service. We watch our accounts on line daily.
    We have always done business with local banks and we were happy. Then a big bank, B of A would buy them and service would go downhill, costs up. I owe a balance on a credit card that is no B of A and as soon as it is paid off, their fired! I have had the card since 1976 and it says so, but they treat you poorly.

    So let me see: the big banks are a bunch of conscience-less thieves. OK, check. CITI tried to cheat both me and my ex at closing, attempting to charge us an early termination fee when our mortgage specifically prohibited that. So they can't regulate themselves. Duh. So they'll do anything for a buck, like the moneygrubbing prostitutes they are. Check and double-check. So how about some personal responsibility? DON'T OVERDRAW! Watch your balance. Keep up with your money. If you don't, you are the lawful prey of these robber barons. Thanks to Clark and the team for the reminders of whom and what we're dealing with.
  • Overdaft and the Domino Effect - how it works
    First off, it's the consumers responsibility to make sure not to overdraw their account; however, the bank fees are "conveniently" designed to maximize profits on overdraft fees. At Wachovia, for example, the bank draws higher amounts ascending to lowest amount for check card purchases made on the same day. This can make a huge difference for someone that overdraws their account.

    for argument's sake, let's say you have 50 dollars (could be any amount really) and you make, say, 7 purchases in this particular order . . . .

    1.P -- $3
    2.P -- $3
    3.P -- $5
    4.P -- $5
    5.P -- $9
    6.P -- $11
    7.P -- 25.00

    total purchases $61.00 -- the buyer had enough funds up until the last purchase, nine dollars short. Conventional wisdom would say that an overlimit fee would suffice for the last purchase and to be fair charge the fee.

    So we'd see an account at -9 dollars, add $40 overdraft and said buyer is -49.00

    But since the banks take out the highest amount first, having funds for all prior purchases becomes irrelevant: his here's how the domino effect works . . . To their advantage

    So as you can see by taking out the higher amount first -- banks profit on overdraft fees -- one purchase that is 9 dollars short can result in almost a hundred more dollars in fees. So it's a two-way road folks when banks allow overdrafts they know a $9 loan can pay off over a hundred dollars back! I don't even want to know what that interest rate is! But for Pete's sake, balance your checkbooks -- one something like this happens you'll learn!

    Over the years, my husband and I have banked with several companies (including BoA, CitiBank, and Wachovia), and fired most of them for poor customer service. USAA has the best customer service - no contest! - and we just keep giving them more of our business: checking, savings, credit card, insurance, etc.

    Sounds like some folks have been totally indoctrinated into believing that businesses are doing all of us a favor by taking our money. I noted some pompous, holier-than-thou attitudes about banks being in business to make money and therefore having a perfectly legitimate right to charge overdraft fees for overdrawn accounts. These lambs-to-the-slaughter folks opine that irresponsible adults deserve to be hit with overdraft fees when they fail to keep better oversight of their deposits and withdrawals. Wow - maybe we should take these slackers out to the woodshed for a whipping while we're at it, too! And why a $35 fee? Why don't we hit them with a $500 fee? While I certainly agree that we need to take ownership and act responsibly, most of us humans make the occasional mistake. In my view, it is absolutely unacceptable for banks to act as shysters in pouncing on those mistakes. We are their customers, and we deserve better than that. Why would you knowingly give your business to an institution doing everything in its power to rip you off at every turn? From the bank practice of deducting larger payments before smaller ones, to their practice of allowing ATM withdrawals or debit-card purchases when they know instantly that there are insufficient funds, these banks work diligently to steal their customers' money. If they were at all into serving their customers versus ripping them off, they could notify them immediately that going forward with the transaction would incur a hefty fee. I don't understand the mentality of a customer who "expects" to be punished by a business rather than served and treated as a valuable asset. As long as we continue to accept this customer no-service and buyer-beware mentality as the status quo, we give businesses carte blanche to run rough shod over all of us. Demand better for yourself -you're worth it!

    10 years ago B of A bounced a $3500 check for $3.46 overdraft on a deposit that posted later in the day. It cost me a career. 5 years ago they charged me $35 late fee on a credit card full balance payoff that was short $3.36 and rolled over. I guess I am a slow learner; but 'never with B of A again'.

    I accidentally put the wrong account in when paying some check with my online checking account. 5 Checks for $300 on an account that I use for PayPal and so keep only $20 in. BB&T charged me 5 overdraft fees. I went in to my local branch where I usually bank, spoke to the manager and asked them why the bank would let me do that if the account didn't have the money. She told me that they had automatically opened overdraft correction as a courtesy. I politely pointed out that I did not request this service and that I was a good customer with a 100K balance. I asked them to abate the charges or i was going to change to another local bank. (BB&T took over the bank that I had originally picked.) The fees were comped immediately.

    In this day and age of computing, online banking allows up to the minute balances on any bank accounts. If there is no money in the bank, don't expect to cash a check or use your debit. For most people who fall under the "overdraft" circumstance, they know well and good they have no funds on hand and thus make a conscience choice to overdraft their account and in that case they should pay whatever overdraft fee charged.

    A bank handing out money they know is not in the account should NOT earn money from THEIR actions. If the bank computer shows insuficient money in the account, the bank should NOT release the money without an overdraft protection in place.

  • Hit in Spite of Overdraft Protection
    When I opened my "Way2Save" savings account with Wachovia, I made sure to link it as overdraft protection on my checking account.

    Yesterday, I overdrew my account for the first time since then. I needed cash and didn't have time to make a transfer from savings to checking, but I knew I had overdraft protection so I'd just have to eat a $10 fee and the funds would be transferred automatically.

    Imagine my surprise when I saw that I'd been hit with $70 in overdraft fees (two $35 fees). I called customer service and they informed me that "that account is not set up with overdraft protection."

    The story at least has a happy ending. I told them very clearly that I am QUITE CERTAIN I set up that overdraft protection at the time I opened the account. The customer service rep agreed to refund the $70 in fees, and to make sure that the overdraft protection is properly configured for the future.

    Still, I can't help but be suspicious, especially considering I am the second person on this list to experience this "glitch." Would it surprise anyone if Wachovia were doing this on purpose, hoping to make a profit from the folks who either don't notice or don't fight it?

    Clark, I enjoy your show and think you have some good points every now and then. Overall you teach people how to save money and I appreciate that. As far as your griping about OD fees, you are off base. You don't want to depend on a computer checking your account first. If that computer is wrong then you may not be able to buy what you need. What ever happened to balancing your checkbook the old fashioned way? Teach people to solve the problem, not punish the banks for making money! These are "stupid fees" that some people need and deserve to pay! Get it straight Clark!

    Several days ago I had transferred over $20,000 in my Wachovia cking acct to pay off some loans and credit card balances. Just yesterday I went to withdraw $400 in cash from my ck acct at an ATM when the screen popped up & asked if I was sure I wanted to w/d the money because it "might" incur an overdraft fee. I quickly cancelled the transaction and did a balance inquiry to find that I only had a $96 balance. Totally shocked I ran inside to ask where all my money had gone. After the teller read a series of large payments that I recognized as legitimate, including one for $8000 that I had forgotten about, I was realived & satisfied that they had recently implemented this new notification at the ATM. However, I could have still opted to w/d the cash if I wanted to incur the fees that would result. Sometimes, a customer may need that capability in a pinch that would make it worth it to him or her. I guess it all depends on what kind of banking services you want and how much you are willing to pay for them. As long as they are up front about it and provide you with tools to circumvent them in advance.

They will link a savingS account to checking account to prevent overdraft & charge no fee.     Don't leave Wachovia off the money list. How about this? They took their monthly account fee first causing me to become 52 cents short of paying a monthly automatic debit; turned around and hit me with an NSF fee. Needless to say I called and let customer service have it. Thank goodness for Clark's bank tips. FYI if this has happened to you call and make them hear your perspective. It worked for me. They could have easily paid both debits and sent me a note saying please deposit 52 cents. Does anybody look out for the consumer anymore?

    I've been using USAA for years for both cheacking and lending. Have not had any problem. It's the best of the best. Also been the BoA and its' predecessors (C&S) for years. Been happy with them also. Only problem was with a local credit union.
  • Don't trust Credit Unions either!
    A few years ago our credit union started holding our direct deposit paychecks until the end of the day trying to bounce some checks. The day they held the check 2 days FOR NO REASON, and we accrued $150 in overdraft charges, I was not happy. But when they sent a notice that said they'd no longer notify us of overdrafts by mail (or any other manner) because it "cost to much to mail a letter" (couldn't spare $1 of the $35 charge and couldn't call or email for free?), that was the day I'd had absolutely enough and moved our accounts.

    Our Community Bank gave us better interest on the checking than we had at the credit union, much more customer service (at the CU everyone was always on the phone with friends and family and the customers had to wait), and if I make a mistake in calculating my checkbook and an overdraft occurs, they will take the money out of our savings account FOR FREE. No overdraft charges. Oh, and they'll call, email and mail us to let us know of the problem. That's service!

    Should have switched years ago, but Clark kept talking up the CUs. I've dealt with 2 CUs and both were nothing like what Clark says. I don't think Clark's CU actually exists.

    I sometimes have addition and subtraction glitches, so I have to say that I am grateful that Wachovia pays my overdrafts. Otherwise I would incur an overdraft fee from both my bank and the vendor. The fee hurts but reminds me to be more careful with my balance. Thanks to a helpful clerk, I now have overdraft protection and still incur a $10.00 fee, but it it better than the $35.00. And, my vendors don't know how bad I cam be at addition and subtraction.

    Those banking fees are pretty high and as a consumer I sometimes feel like there's no one but Clark speaking up for me. I hope Congress reigns them in a bit and adds some additional consumer protections.

    Wachovia Bank now is charging $2.00 each time you call their toll free number and try to talk to customer service. This happens with me two times last month.     Bank Of America has been charging overdraft fees if your available NOT Actual balance goes negative.

    If you have $50.00 in your account and use your check card for dinner that costs $30.00 if the business makes a mistake charging you $35.00 and then runs your check card again for the correct amount $30.00 you will have 2 holds against your account. The total of the holds is greater than the $50.00 you had available.
    Even though the incorrect amount will fall off and that money will not be taken from your account Bank of America will charge you a NSF fee because your available balance(NOT your Actual balance) is negative. If you look at your statement you will not see your account negative until the Bank NSF fee posts.
    Is that even legal?

    Wachovia charged me $140 in NSF fees the other day (3/24/09) even though I had overdraft protection. When I called the 1-800 number the woman who worked in customer service refused to explain things through with me, other than to tell me their new policiy was to charge me first then use my overdraft protection. She told me it was my fault and that they could only help me with $40. I went to my local branch and they couldn't explain what happened. Turns out they ended up apologizing and returning all of it..."it was a computer glitch"....right whatever. Needless to say my husband and I are researching local credit unions. We had been with (for over 14 years now) Southtrust, who was bought out by Wachovia, who was bought out by Wells Fargo......thanks but no thanks I am officially done (not the first time they have ripped me off, but it's certainly the last!!!)!

    At Bank of America you can set an alert up on-line to email you when you balance gets below a user defined threshold. I would presume other technically savy banks have a similar feature.
    As for Mohammad and his $36.79 Starbucks coffe I can only say one thing..... Put a $10 bill in your pocket and use real live currency. I can't feel sorry for anyone who uses a debit or credit card for a $1.79 purchase.

    I have checking account with Bank of America. I do my banking online. I simply dont understand how they maintain account balances. They charged me overdraft fees many times. Their online banking is so complicated and confusing that even though you have enough available balance and you make a payment and you will be surprised after few days to know that your account is in negative and they have charged you $ 35 many times. I bought starbucks for $ 1.79 and they charged me $ 35.00 as overdraft fee. I stopped at Kroger for gallon of milk, bread and eggs for about $ 10.00 and they charged me $ 35.00 on it. This is not fair.

    Because I earn very little interest in my checking account, I keep it as lean as possible and transfer money to it from my savings accounts 2 or 3 times a month. Occasionally, I've added wrong or put the wrong date to transfer money, and ended up with less money than I needed to pay bills. My bank, ING DIRECT, will not pay bills unless I have money to cover the transaction. That's the way it should be.

    I don't use my ATM card very much and have never overdrawn my account that way. I know that ING BANK sets up an overdraft account that you borrow from, just like in the old days. And if you try to pay a bill using the online bill pay, but don't have enough money to cover it, they won't send the payment.

    I was having the same problem with occasional slip and henceforth overdraft protection fees with Wachovia. I opened 2 different credit cards with them - which led to upgrade of my account to Crown Banking, No overdraft fees any more. I also Bank with citibank- they have never Charged me overdraft protection.

    While people should be accountable for their actions, banks should not allow one to overdraw from their account. If a person with $20 in their account went to the bank, and wrote a $60 check on their account, their bank would not cash it. What's the difference?
    As per getting a balance via phone or at the ATM, the balance may NOT be correct! The balance does not include any pending charges to the checking account. It only shows what is left in one's account at that very moment.

    Recently, my wife and I switched to a credit union from a mega-bank. Shortly after transferring all automatic payments for loans, I got a call from my credit union telling me about a pending charge that would overdraft my account. Seems my mortgage payment went from being taken out on the tenth to being taken out on the 1st and that mega-bank never bothered telling us about the change. After this experience, I find that overdraft can happen even to responsible adults.

    Balancing a bank account is simple math. Why shouldn't banks let you do it, you're the one saying you want to, and if you read the account policies you know there's a fee! And at most major bank ATMs it's free to get a short recent activity print out much less just your balance. I don't have a problem with people doing dumb things getting having consequences, the idea is they should LEARN from their mistakes. Why should banks have to babysit. I don't want people babysitting me. If I do something stupid, fine, I take the consequences like an adult, and pay more attention in the future. And for the record I've only overdrawn my account one in my life (I'm 33) and I was 16 and forgot about the monthly fee. It's very simple. Balance your checkbook/account and only spend/get money you have and you will never overdraft! I honestly don't care what banks charge people who aren't being responsible adults. If you can't handle the responsibility of something, you shouldn't have it.
  • No you should not overdraft, but when the bank rearranges the order of the debits so that they can maximize the fees that is very wrong. If you do 6 small transactions from Friday night to Monday afternoon that do not overdraft you, but do 1 large transaction on Monday that overdrafts you and they charge you fees for all of the transactions there can be NO justification. None at all. It is out and out theft and something should be done so that they are required to post transactions in the order they are received.

    You can call the telephone number on your Bank of America debit card at anytime of the day and it will give you your balance instantly. No need to overdraw. Bt i do have a little problem with BOA that i need to resolvec that i caught the other day. All in all they are a fair bank so far.

    My goodness, hasn't anyone ever heard of a Bank Credit/Debit card? I have one through my bank and use it (Visa Bank Card) as Visa everywhere I go. It's that simple....if the money isn't in the account, it isn't approved "on the spot". I love it and my bank doesn't get rich off of me! Has noone ever heard of the Bank Card???     Years ago you could go to a bank and request a personal loan for $500 with very little interest or option to pay it back in 90 days. Now they want you to use a credit card and ask you borrow no LESS than $3,000. So who is making money on that deal?
    BTW-don't use your ATM card at other banks than your own, the charges can add up.
  • Responsible Banking
    It is up to YOU, the holder of the checking account, to keep track of your transactions and deduct the appropriate amount from the balance in your account. It is also YOUR responsibility to reconcile what you believe your balance to be with what is being shown by the bank. It is simple addition and subtraction and if one cannot do this, then you shouldn't have a checking account. I keep all my transactions in an good old-fashioned check register, which still does come with your checks, by the way. This includes ATM withdrawals, debit transactions, online bill pay transactions - both one time and recurring and checks. With the ability to check balances and transactions at will online for most banks, there is absolutely no excuse for overdrawing an account.
    Also, banks are required to post their depository rules and requirements -- pay attention to the small type! It is your money and YOUR responsibility to keep track of it. Clark has totally missed the boat on this one.

    Of course people should not be able to do overdrafts. But the bank should not allow them either if they can check that. Why give me cash at the ATM or allow me to purchase something with the debit card if they know my account does not have enough money. Perhaps a previous transaction accidentally went through twice. The fault is not always my own. But the point is, don't allow me to dig a bigger a hole and allow negative transactions to go through.

    BBandT accepted out checks on Sat. but only show 1/10th available. They never told us that they would be delaying the posting of the total deposit. They don't even show the total deposit in the pending amount! They'll accept the debits that will be coming today before they post the balance of our deposit. If anything bounces because of this act--we closing the account. They are just like the rest.

    As an employee of a bank, I can speak from personal experience...we are instructed to push checking accounts and atm/debit cards as much as possible because that's how banks make majority of their money, from people who o/d their accounts using their "free" checking accounts and "free" atm/debit cards...everyone beware!!!
  • Back up with Credit Card or Savings account
    To avoid overdrafts simply ask your bank to back up your account by linking it to either your savings or a credit card issued by the same bank. This way if there is an overdraft they will automatically withdraw funds from either of these accounts and add them to your low balance. I have not paid any fees in 8 years with Bank of America.

    Just have extra $500.00 in your account all the time. You will never face a problem. I am with Bank of America for last 10 years and never had a case of extra fees.
  • Use Internet to keep track
    Obviously these banks take advantage of those who do not want to take the time to keep constant track of their banking activities. Nowdays is so easy to do. I personally go into my account with Bank of America at least twice a day, make sure no deposited checks have bounced, etc. I'd say banks are taking advantage not of their customers, but their careless and lazy customers.

    There is no telling how many times I have overdraft without even being notified that my check has not cleared or because I was just allowed to go over my limit. The bank knows how much money is in your account. They are just greedy and want more, more, more. That is why I try to just use cash. There are no overdraft fees with cash.

    I deposited a check at my credit union ATM in my credit union lobby on a Sunday when the credit union was closed. They held my check for two days after that which made me get overdrawn.     I normally pay off every week my CitiBank credit card acount, so in a way i used the card one week and the next week i pay it off. Up until now, citi did not charge me anything, on my last statement, they added a balance charge. I stop using CitiCard. I do the same with discover but they don't charge me anything. I make a prediction, in a few years from now, newspapers will report all the fraud the banks did with the bailout money, i can just see it coming.

    I am a small business owner of 4 years, and BOFA has a new trick out there- beware. even though I have not overdrawn my account, they have 'opted' to hold my deposits for 14 days. when i quizzed the branch manager in person about this new policy, she said that it was an old policy, and that it was because my clients' checks were from out of state. when i showed her the last 9 deposits from the same out of state client, and that BOFA had cleared them in 24 hours, her reason changed to the amount being high. when i pointed out that my recent deposit was less than the older ones, her reason changed again, this time to 'we have always reserved the right to hold checks'.

    i do suspect that i am being targeted because of the industry i am in- architecture.

    i suspect also that BOFA is holding deposits to make the interest off of my deposit during the 14 days that they get to hold it.

    beware- I was even told by the teller that my check would be available in 24 hours. this is the second time in two weeks that this has happened. The tellers do not know that the holds are being placed after hours. If you need your $ before 14 days, go to the issuing bank and cash the check. do not take the chance. for me and my small business, it means the making payroll or not- I will be moving my account as soon as the funds clear, and i'm sure BOFA won't care.

    I work at a bank and I see each day the way people OD their accounts. The #1 cause of this is people do not keep TRANSACTION records. An ATM, a merchant terminal, etc they have no records of outstanding checks/auto payments that the customer may have. Only the customer has that knowledge and it is their responsibility to keep track of their financial obligations/expenses. It does not matter how a bank processes their transactions, it you don't have enough money you will OD your account and pay very hefty finance charges to do so. CAN'T WE ALL BE FINANCIALLY RESPONSIBLE?

    I have a car loan with Citibank. The final payment was this month. All payments were automatically withdrawn from my checking account... except the last one. They didn't bother to tell me that, and now I've got a late fee to pay. Beware!
