Jan 29, 2009 -- Beware of scams promising to stop your foreclosure

RIP-OFF ALERT: In most states, there are public records of who is falling behind on a mortgage. That's created an opportunity for swindlers who show up at your doorstep with a "personalized foreclosure rescue package" for you.

Likewise, we've all seen the "stop foreclosure now" signs on the side of the road. The punch-line in both cases is that you have to pay money upfront to stop the foreclosure. The average amount these swindlers steal from people is around $3,000, according to a recent New York Times report.

Meanwhile, there are some legitimate parallel tracks you can explore if you're facing foreclosure. These include seeking free counseling from a local affiliate of the National Foundation for Credit Counseling or going through the HOPE NOW Alliance. Be forewarned that Clark thinks the latter is a "political puff piece"; he'd prefer you go with the former option.

Lastly, you can try contacting your lender directly if you're in dire straits. It's surprising how many people won't talk to their lender when they get in trouble. Bad move.

    I felt it was necessary to revisit this site and share our experience with the Law Offices of Brett Margolin and our mortgage modification. My husband was in finance for years and was laid off 2 years ago..times got really tough and we were borrowing from Peter to pay Paul. We tried reaching out to our lender, with absolutely no avail...total runaround..they actually suggested we go 3 months late before they would even talk to us.. My husband being a financial advisor, credit is very important for employment so we chose to continue to borrow the funds and minimize our late payments. I went online, and the next thing I know we got 5 phone calls from attorney firms! One from a member of the Law Office of Brett Margolin. We had a great discussion, they said they could help and they sent me some info via email and it sounded really good. The legal assistant sounded honest and to be the most knowledgeable out of the bunch calling us... so before sending off our money and info to the firm my husband and I did our research. We saw this site and some other sites and were VERY reluctant to move forward. We stalled for about a month. Finally we decided to take a ride to visit the firm in Lake Grove and meet with the legal assistant to help make our decision. We were actually very pleased with what we saw. We decided to move forward, considering they do have a 100% guarantee on our retainer money. That was 3.5 months ago. The process did take a while and we were nervous the entire time, but we finally got an offer from our bank and it is great! 2 late payments rolled into balance, taxes and ins now included and a payment which we can actually afford. After we pay it for 3 months, we can get a permanent modification based on these same terms. We could not be happier! As someone who has actually seen the firm and met with them and now had a successful modification, I feel it's necessary to share our experience. Sorry this is so long but I hope this info can help someone else. There are people actually willing to help out there.

    I just got off the phone with someone from Brett Margolin Law Firm - has anyone figured out if this is legitimate? I have tried doing a modification through my lender and have gotten a total run-a-round. I'd like to find some real help before foreclosure!!!

    I was just offered a position to assist people in getting loan modifications done by paying a retainer fee of $2,450 to the Brett Margolin Law Firm. They said that they take the applications first, then let the client know if they qualify. Then they collect the fee and if the bank does not come through with the loan modification, the fee is refunded. I wish I knew how to find out if this is legal, if it really works with the banks or if these guys are just the run of the mill scammers. any ideas?
  • NEVER, NEVER fall prey to these people. My son has worked in the banking business for 20 years and will attest most if not all are simple scams which will take your money and leave you high and dry. Some even instruct you to stop paying your mortgage to the bank and send it to them instead (in which they will work out a loan modification with your lender). I know of no quicker way to loose your house if you are foolish enough to "buy into that." Go to a housing counselor, work with your bank or contact a legit legal firm. If not you will see you will see the money you have paid these scamers along with your house vanish--just like they will when you attempt to reach them for recourse after they have taken you to the cleaners.

    access loan modification promised to help me save my home. i have given them a total of $799.00 which $400.00 wasn't suppose to be drafted until they got an ok to do so. now they call me up saying my bank (chase) wan't $1500 toward my late payments.

    What if you do not have any other options for a loan mod - we can't wait for a long drawn out process, we need someone who knows what they are doing.

    I have been trying to get a law firm to do my loan modification but I'm having hard time finding a good one. I talked to "The balanced legal group" firm after hearing their ad on XM radio and they seem OK. However, i couldn't find any reviews/complains about them on the web. Anybody knows something about this firm?

    would you go to a dentist for a blister on your foot.? Why do you think then that a normal person can get the same results that a professional can? Yes people need to be aware of scams and over charges. As professionals we get in to the right people at the bank/ lender and get them to take " the voluntary participation" of Obamas cram down plan. There is no law that says the banks have to take it, but when you show them the flaws in the loan and knowledge of the lending laws, they seem to buckle.
    So all you naysayers who don't want to pay a professional fee and think some acorn org or hope now program is going to save them my suggestion- START PACKING- THEY DON'T WORK

    The reality is that many of you posting negative comments about the law firms in the country handling this matter, are in fact representatives of some of these companies ripping off people.

    Forensic loan audits and loan modifications completed by law firms that are LICENSED sure beats these rip-off companies who takes people's money and run or the lenders who lie and say you don't need a modification or that their mortgages are legit.


    Think of it this way, if you had to represent in yourself in court, you have every right to do so. However the outcome in a legal situation is always better with legal representation. The bank's best interest in negotiations is always their own and they will never negotiate and make offers to you that are as good as they do with us since we have a professional relationship with these lenders. They might make you a good offer, but why take that chance?

    The banks for the last few months, due to the modifications happening have been offering homeowners assistance telling them they don't need to pay for a modification, because they are looking to protect themselves from people who may discover the violations and force a better situation.

    Do NOT pay a penny to get a loan modification. These are gov. guidelines that banks should follow. Either go to a housing counselor in your county, also free or call your bank and ask for the Loss Mitigation dept. Tell them you want an appl. for loan mod. under the homeowner affordablility & stability plan.
    Banks are VERY busy now with all of these new loans to do, so Be patient.
    On Sat. I called five different numbers and each one sent me down the line like I was a ping-pong ball. They did say that they will FLAG my account so they know to call me if I qualify. Who knows if they will, but I'll call them soon.
    As of now, peeps, get busy researching and getting your paperwork ready. Write a hardship letter saying why you are in this mess and what you will do to get out, as in get rid of debt and the luxuries etc..
    Be prepared and presistent and wait. I've been pro-active in this, spinning my wheels of course, but in the end, I hope I qualify and get to live in my home forever.

    Contact a local non profit or your bank yourself they cant do anything you could not do yourself. Also most of thease mod companys will be shut down for over charging people and legal issues. just google "loan modification scam" and see the truth

    AFCC (American Foreclosure Counseling Center) I don't understand. If I'm behind on my mortgage how can they possibly ask for my mortgage payment plus $200.00. If I had $1400 I'd give it to my mortgage company. I really am confused about all this and don't know what I'm gonna do.

    Company called "Coast to Coast Relief" that specializes in foreclosures, loan modicications, etc. for a fee of $500.00. Can't find anything at BBB. Are they legit or is this a scam??

    I have had a similar offer from Best Interest Rate Mortgage Company. They want me to pay an amount equivalent to one mortgage payment. They claim to be able to lower my interest from 6.3 to around 4%, have my past due mortgage payments added to the back of my loan and provide a 3 month grace period for mortgage payments while my loan is under mitigations...all while bringing me current on my mortgage and stopping any pending foreclosure proceedings.
