Sep 24, 2008 -- Credit Cardholders Bill of Rights passes House, on to Senate

Credit card companies long ago adopted the same tactics as hoodlum drug dealers on the street corner. Pushers may get people hooked on pot, for example, but the real money is in cocaine or meth or what have you. So a drug dealer will give you a free sample of the big-money items to lure you in and create a new revenue stream.

Banks do the exact same thing with credit cards. For years, they deluged your mailbox with debt solicitations. Once you were hooked, they would turn around and raise the interest rates on your existing balances.

But that practice may soon be coming to an end. The House, in a 312-112 bipartisan vote, approved what's being called the "Credit Cardholders Bill of Rights Act" -- and the bankers are squealing like pigs. The bill would halt rate hikes on existing balances. In addition, it would require 45 days of notice if there is to be any interest rate change at all for future balances.

There's another provision of the bill that Clark's particularly pleased about. His American Express bill showed up 4 days before the due date -- fortunately he pays online! Under the bill, banks would have to mail statements 25 days before the due date.

Now the bill goes to the Senate. You just know the banks will be using dirty money to prevent the bill from coming up for vote. The president has indicated he'll veto the bill, but it won't do him any good if it passes both the House and the Senate with a veto-proof majority. That's why the Senate will be a key battleground.

    BOA offered me a no interest/finance charge card in March 2008 - I have had to contact them every month to tell them to reverse a "finance charge". When I asked the rep what the finance charge was based on for the month (because it changed month to month from .02 - 39.00) she said she wasnt sure. Then in October they changed my due date with basically no notice and because I did not pay them on a whim they determined they want to charge 29.00 late fee. Its crazy - thank God im not relying on credit to pay my bills. I know many do but they dont have that kind of leverage on me at this time (knocks on wood)

    A bill, which went into law in October of 2007, capped interest rates that payday loan stores could charge military personnel at 36 percent. The analysis behind such an extreme was based off the increasing number of American soldiers in the Army, Navy, Air Force, Coast Guard, National Guard, and other branches, who found out that loans were being taken out under their names without their knowledge. This sometimes sets them up to be victims of identity theft. Other times, their spouses take out loans in their names without their consent, and then defaulted on them. When the people ruled in favor of this measure, it seems they were assuming that members of the military, who traditionally are low-income folks, have little to no financial know-how. In 2006, both current Presidential candidates, Barack Obama and John McCain, gave eager support to the bill that took away a select group’s access to no fax payday loans. Now, Obama has gone on record, declaring that he supports the same idea that will affect the rest of us by driving the whole entire industry out of the country. With this in mind, think about our financial freedom that is at stake before casting your vote.

    You know up until now I havent 100% been against Bush, but this indicates he is planning on vetoing this bill. I know I just changed my mind and now I really dont like him anymore. When I borrow money for a car or anything else it is an agreed upon rate and so should charges on my credit card.
  • Unfair to change the deal
    Changing the rate AFTER you have an existing balance is like welching on a deal. You and they agreed to an interest rate, then they bump it by 10 percentage points or more because you are in trouble elsewhere.
    I really hope this legislation goes through.
    I also have gotten bills late, though for one recently I'd moved and called the credit card company to have the late charge removed. The customer service rep was very helpful.

    I use a list of all my bills now, and check it every second week online. Even if a bill is delayed or lost, I'll still have a chance to pay on time.

    I've also started making online payments for the last two weeks of charges, so I don't run up the principal balance. Often this means I make the minimum payment twice a month as well. It helps reduce the interest.
