Aug 21, 2008 -- New FTC rules to clamp down on automated calls

All across America, people have filed complaints about the plague of automated calls coming to their homes. The recent surge in "robo-calls" is because they now cost a fraction of a cent to make thanks to the Internet.

The FTC has now issued new rules about robo-calls. Starting just before Christmas, you'll have an option at the end of a robo-call to press a button that indicates they can no longer call you. Then, beginning in September 2009, companies will actually have to ask for express permission before they even call you.

If you're on the Do Not Call list, you should already be exempt from robo-calls. Of course, that's not always the case. So will robo-callers really comply with the new FTC rules? Clark doesn't know.

Clark's solution to the problem is that he and his wife never answer their home phone. All calls are screened by an answering machine. He recently cleaned out the answering machine and found only 1 out of 42 calls was legit. And they're on the Do Not Call list!

Several categories of businesses will be exempt from the new FTC rules, including banks and airlines. With banks, they are allowed to robo-call you up to 18 months after the end of your business relationship with them.

There is some controversy over whether calling to inquire about a bank's services constitute the start of a business relationship -- even if you never do any further business. This remains a gray area in the law.

    Jim The Engineer and Clark are both half right. While there MAY be a report on file with the BBB, it is not too hard for the company to get that report removed. Also, if they don't care to follow federal law, why would they care about a report at the BBB?
  • Wrong Number from Collections
    For several weeks I was on the receiving end of a wrong number from a bill collector looking for a Jose Martinez (sp). I started collecting names and info from the callers. Again, all the while stating that it wasn't me. I learned much about the individual they were wanting to collect, including their SSN number and amount owed. Again, all the while claiming not to be the person and that they had the wrong number. I later compiled the info it into a letter to the BBB. With what they shared with me they could be sued by the real Jose. I hope they are. The calls to me stopped finally. I did receive a response from the BBB stating that the company (RDC)had responded to my complaint. Its on record now. I hope other people use BBB. This information filed with the BBB can be used to show the collection agency does not abide by the credit reporting act. Clark stated nothing could be done.

    After they call the first time - I block them! We have Voicepulse which is VOIP like Magicjack but it is $15.99 per month. If someone calls me I don't like - I can go into my Voicepulse account online and enter the number and the filter I want set up. The filter will send them straight to voicemail, or play a busy signal every time they call, or even say the line has been disconnected! I considered Magicjack seriously but I just can't give up the control I have. You can set up do not disturb times also when you don't want the phone to ring.     Here's what we did - we called AT&T to disconnect our land line - they have specialists that try like heck to get you to keep your phone. I finally got through to her by telling her that I'm tired of paying for something that allows others to harrass me, to which she replied that there was nothing AT&T could do about that, to which replied "yes, I know dear, but I CAN do something about it, and I'm choosing to close my account, and you're going to help me do that, RIGHT???". She FINALLY agreed to help me after 30 minutes of this. We then purchased a MagicJack and love it!

    We travel for 3 months in our RV and call home to find dozens of these calls in my answwer mach.....when I am home and press the #2 to remove me it does not work...they call again and again......I responded to the caller and yelled at them to get me off the list.....they just hung up.

    In Nebraska, one must hire an attorney to sue the company who calls, even if one is on the "Do Not Call List." So what good is the list?

    The worst offenders on my phone are politicians, and I'm sure they'll continue to be exempt from all the rules. I don't want any of the pols to call, but it really steams me when a party to which I've never belonged and never contributed a penny call and start out by thanking me for my "loyal membership." My solution is to let the call go on for a few seconds - I've heardthey have to for the call if it lasts long enough to register, and then hang up. A friend just walks off and leaves her phone off the hook because she heard they can't disconnect until she hangs up. Don't know if this is true or not.

    If I get a live person calling, I make sure they are someone that doesn't really have a real right to be calling me, and then I keep a very loud whistle next to my phone. I blow it really loud into the phone, thereby busting their ear drums out. Then I warn them not to call me again.

  • My rights to end their "right" to call
    Is it not true that as soon as I tell them (or anyone else for that mater) not to call me anymore that they must comply under any circumstances? I believe this is a part of the "do not call" regulations that are regularly skipped & has always been true under anti-harassment laws---at least in the state of Michigan. Please remind people of this as most seem to think they have to put up with for as long as the reg says they are allowed to call you.
    I have gotten several to cease with complaints to the BBB &/or Atty Gen when they have not agreed with me. I just can't understand the thinking that I would eventually break down & buy something from them after I personally told them that they were violating my rights after I expressly told them to cease & desist the calling & told them to check the website (it's clearly in the State of Michigan version) to confirm my rights to end their "right" to call.
    Another strange one that insists on calling is a nut-job company that assumes every telephone # related to a business is a retail store that would be wanting to use their credit card processing services. I am a sole proprietor using my home phone & have told them it is my home phone & on the "do not call list" but they refused to stop until I filed a complaint with the BBB--then tried to fight it!I have even encountered this attitude with bankers assuming that any business must be automatically selling mass quantities of things & also has employees! I guess they haven't heard of a service industry or part-time sole proprietors.
    The credit card processors seemed to think they were exempt from getting the "do not call" listing stuff--maybe just in case of changed numbers or typos & thought it their "right" to call since they got my home number from some obscure place listed as a business (I'm not even listed in the white pages under either name) & didn't think I had any right to tell them to stop---until I filed with the BBB.
    One time a collection agency kept calling for a wrong number & refused to believe me---problem was that I was spending some weeks at my parents 300 miles away so had my phone on "call forwarding" so every time they called I was being charged a long distance call. I nipped that one in the bud when I explained the situation to my home police dept--who was nice enough to give them a call.

    In my line of work, I have calls that go out to people all over the country, and it makes me crazy when I get a call on my cellphone that I know is from out of state and it turns out to be a telemarketer recording. A pox on all of them.

    I get "robo-calls" that don't disconnectwhen i hang up. The recording keeps on going even tho i have "disconnected. This can go on for several minutes...what can be done??

    it isn't enough to tell them you are not interested. if you don't answer the telephone, they leave a long long message that ties up messages you want to hear. we finally cancelled our land line with at&t.. but in the end we had to contact the fcc in order to get assistance to cancel.. they put us through to a telephone number which appeared to be a special at&t number and our service was cancelled immediately. i found out from an at&t truck that at&t would not honor our cancellation request. what a hopeless situation. we would prefer to have a land line especially for ld calls. Our son is in the navy and ld calls get very long.. naturally. glad to hear you are on it. you have been very helpful to us for many years. pls keep up the good work !

    An idea: If banks & others are allowed to continue to pester us, we should all decide which of them to call, and on a specific time, on a specific day, ALL call them (at a number that is important to them) at the same time. That will shut them down for a while.

    We're on the do not call list too. Doesn't make a tinker's damn!

    I'm on the do not call list, but you wouldn't know it from the calls I get. They are all recordings so I don't even get the satisfaction of yelling at them. The political ads are so bad that I don't answer my phone when it's close to an election. One day I had 4 political messages on my answering machine within one hour! I think they should pay my phone bill.
