Apr 30, 2008 -- Collection calls being outsourced

As people are being financially squeezed, the rate of delinquencies on auto loans, credit cards and HELOCs is rising dramatically. Of course, it goes without saying that the collection agency biz is a huge one. It's also the latest thing to be outsourced, according to The New York Times. Collection agency calls are being sent offshore to countries such as India.

As kind of a corollary to this, you may notice that you'll start receiving collection calls out of the blue if you have old debts. Collectors are looking at the tax rebate checks as money to be tapped immediately on past due debts.

If you do get the call, what are your rights? You have the right to tell them in writing not to bug you. Use Clark's drop dead letter to help. If they don't comply, you can take legal action against them.

There is one exception to this rule. Banks are allowed to use their own in-house employees to act as collectors. They must, however, stop short of threatening you with physical harm.

Collectors are also allowed to call about a debt even if it's very old. In many states, these "zombie" debt calls present a double danger. If you pay them even as little as $1, they can turn around a file suit on the debt to get a judgment against you. Even if it's 25 years old! So watch out…

Finally, Clark always wants you to honor your debts. If you can't do it right now, wait until you get back on your feet financially and then do it.

    If you are getting collection calls make a script for yourself to collect information from the callers. Ask the name of the person you are speaking to (probably an alias), then get the name of the company they work for, then get the MAILING address. Now send them a registered letter telling them to not call anymore...they can communicate by mail. The telephone if NOT your friend in these cases, it is a tool that works for the collectors. Talking, screaming, even cussing a blue streak only encourages the collectors. I used this method to stop calls for someone whom I had never heard of but apparently used my phone number to obtain credit. I also used it to resolve an ID theft issue for my roommate. So save your breath and PUT IT IN WRITING!
  • Credit card debt of Mother
    A credit card co has turned my mother's credit card over to attorneys who in turn have filed a judgment against her. She is in a nursing home with only SS as her income and that goes for paying for her care and she has Alzheimer's. They served papers in my county because her mailing address is mine but resides in another county and her property is in a 3rd county. What do we need to do to answer this judgment since she can't do it herself. We can't afford to pay it for her and can't afford an attorney. Can they come after the family for this debt even though we had nothing to do with it?

    My Son in college stopped paying his credit card, He is getting the harrasing phone calls. They threaten to take him to court today if he does not pay. He does not have the money. I told him what you have said about not paying 1.00 because they can take you to court. But how does he make good on a bad debt to the credit card company when they sold his debt.
