Feb 15, 2008 -- Fight back against zombie debt collectors

RIP-OFF ALERT: Zombie debt is a lucrative and illegal part of the debt-collection world that Clark wants to warn you about. Scavenger collectors buy up expired debts that can be up to 30 years old for as little as 1 penny on the dollar. Then they unleash vicious collectors to try to collect, and frequently violate the Fair Debt Collection Practices Act in the process. They may be going after debts set aside in bankruptcy; stemming from ID theft; or that have passed the statute of limitations, which is typically 4 years on credit card debt. There is no legal way they can collect these debts, but that doesn't stop the scavengers from trying to intimidate you.

This is not a discussion about whether or not you should pay your bills; this is about what your rights are on old debts. The scavengers are so good that they typically collect about 13 cents on every dollar. Many of them also engage in illegal activities by wrongfully putting old debts back on your credit report; harassing you over the phone; or secretly taking money out of your account. If you're being harassed by a zombie debt collector, send them a certified letter stating the debt is invalid and instructing them to stop contacting you. But beware that scavengers don't care if the debt is valid. They've declared war on your wallet and will use any tactics. Be tough and know your rights.

    Due to the ecomony I had to close my business with 2 outstanding cc debts. After 1 yr. of making partial payments and racking up hundreds upon hundreds of finance fees AND a multitude of phone calls back and forth, Discover contacted me and put me on a hardship program for one year and reduced my interest rate from 32.9% to 5.99 %. On the other hand ADVANTA refuses to deal with me, raised my interest rate from 1.99% to 34%, racking up hundreds of $$ of interest and finance charges and the debt continues to grow and they continue to cash my checks for partial payment. Now I'm getting calls from debt collectors saying they have assumed my loan from ADVANTA and are ready to settle. They won't send me any info relating to the loan "assumption", they don't have a web site and they will only give me a PO Box address and will not provide their business license info no a physical address. They said they are "NCB Management" and I'm supposed to be sending my payments to them. I'm still getting statements from ADVANTA. Any suggestions?

    I have a chase card. I called them 1 month ahead of not being able to pay my full payment, due to loss of work from the economy. I was told, I had to be late for help, so I was late & stated I could pay $50 a month, which the man said call when you can pay $100. Months went by & I decided to answer the phone, they wanted $79 a month to get me caught up. I paid the first & then decided noway! I have asked many, many times for them to take off all the late & high interest rates, since I did contact them prior to all of this starting.. They have refused & said they would be writing if off as bad debt in 2months, I said go ahead. we are so tired of dealing with them.. Is there anything we can do? other cards have worked with us, not this one.

    Advanta has raised my APR to nearly 35%, at which point I stopped making payments, called and wrote the company to lower my APR (they refused). After not making payments for three month, the following offer was made:
    5 year pay-off plan, monthly payments of $175, and an APR of 9.9%.
    Should I accept this offer ?? and it is funny how you can get their attention if you don't make payments.

    You could call but you would have to be very careful about your wording. These guys are experienced and they can twist your words around to mean, "Yes, I will pay you all of the money you are asking for". Why aggravate the situation when you have the letter on the way....

    On a cell number which only appears on my resume, I get a recorded message about a debt and reference number and an 866 number to call. Annual credit report is clean. Not aware of any old debt. Should I call back out of curiosity?
    Googled the 866, have address. Certified mail is on the way.

  • Zombie debt?
    I am not clear what the criteria is for a zombie debt. I have debt that was 'closed' by a service provider - meaning the debt was legitimate but was no longer sought by the provider. When I contacted the provider recently, they rep told me the debt was written off and I could resume business with them if I chose to. The debt was sold, and I have been contacted by an attorney acting on behalf of the company that bought the debt. I now have the means to pay the old debt (which I want to pay to the provider). Am I legally obligated to pay the debt collector/attorney? How is the statute of limitations determined for debt - from the laws of the state where the original service provider is headquartered?

    Nine years ago I had a few huge outstanding debts develop from our credit cards while my wife was gravely ill for nearly two years and I was off work helping to save her life..I fought off all of them by litigating myself.Stop the phone calls with Howard's Drop Dead letter. I had nine ZOMBIE attacks and beat all of them!!!Always appear in court if it gets that far..(I went twice-they showed up once and gave up , the second time they tried to sneak a judgement in with clerk's help..but ended up losing on that too)dIt was very simple: Simply demand from the ZOMBIE actual "VALIDATION" of the debt.(this includes copies of original contracts, all transaction records of charges and payments, interest on top of interest and late fees run wild,and DATES of same). I believe that in 90-95% of the cases they simply do not have this information!!!!! YOU WIN AT THIS POINT! Fight Tehm..don't give up..get your credit reports and fight back..always copy FTC, congressman, consumer advocate groups..threaten to sue them under RICO.Don't roll over..get them back! P.S No lawyer's fee from me..but I suspect most people should consider one if problem is substantial.
