Feb 11, 2008 -- New bill promises to control credit card companies

There's a bill in Congress to rein in the giant monster mega-banks and their abuses of the public with credit cards. Credit card bills are often due "net 30," which means 30 days after the date the bill was posted. The credit card companies, which are mostly owned by the giant monster mega-banks, have found that they can generate massive late fees by shortening the amount of time you have to pay. Some companies even have it down to net 15 just so they could post late fees of up to $40! Unless you pay electronically, you can't prove timely payments.

Clark was recently talking to a man in Austin who electronically made a credit card payment the day before it was due. The company received it on time, but waited 48 hours to credit his account. They then charged him a $35 late fee and raised his interest rate 15 points. Clark thinks that's despicable. This industry is missing any morality and doesn't care about treating people properly. The federal regulators, meanwhile, only act as the industry's protector. This new legislation would require you be given 25 days to pay your bill; it's ridiculous this has to be done by Congressional act. The legislation also wants to make it so you get 45 days notice -- instead of the current 15 -- that your rates are going up. Clark thinks they're addressing the wrong problem with that latter measure.

The real problem is that the credit card companies are hoodlums because they agree to make a loan to you, get you hooked and then raise the interest rate on loans you already took out. If Congress wants to help the credit card companies, they should allow them to raise the rates on future charges -- not on amounts that are outstanding. It's been said that people love their credit cards, but hate their credit card companies. This is true with any addiction. Credit card debt as a way of life used to be a uniquely American experience, but the international financial press is reporting the same story around the world. The sad thing is that the banks give so much money to Washington D.C. that Clark doesn't foresee anything changing. So you've got to be responsible for getting your balance paid off. Don't carry a card if you can't control yourself. Also, try carrying a check register to subtract your charges from your savings or checking balance so you know when to stop charging.

  • Huntington Credit Card Scam Artist
    While I know everyone is complaining about Chase, Capital One, and others, let me name Huntington National as another! I have a credit card through them with a $4200 dollar limit at 6.5% to start. Since this battle begun to tame the C.C. companies, Huntington jumped my iterest rate to 8% then, to 12% then 16%, then 19% which began Aug. 1st, and now is 27% as a so called default rate and I just got notice that if the balance is not paid down, it will increase to 34%. Since all this has happened my balance has gone from $3000 to $4300 due to their fees and put me over the limit!!! I have tried to get other credit cards at a lower interest rate to transfer the balance over, or get a loan at a fixed rate to pay it off. I have successful failed in this battle with my mega bank. I have tried to contact Clark for advice and i have been paying upwards of $300 a month to try to pay off this credit card. Yet it is absolutely down no justice at all. The only only option I feel I have left is to close the account and then pay it off and take a major hit on my credit score. Yet due to this, I won't be buying anything major anytime soon anyway!

    I think this new law does nothing to protect people like me who have always paid on time and more than the minimum monthly limit.

    Clark if you or anyone else has any good advice, I love to hear it and ASAP!

    I have not use a credit card since 1998 yet capitol one sued me and the case against me was dismissed in fulton county court, now last week I received a noticed in the mail saying that they were going to garnished my wages, it is outrages, the fact are that i was the subject of identity theft 3 times and my husband past away 16 months ago now I have to deal with all that. I do not understand and do not know how to move forward one day I receive a letter saying the case against me was dismissed and the next day i get a noticed about a garnishment. Please help me figure out what to do next. I am totally lost.

    I totally agree with these comments and adding mine about the C.Card decreasing my limit down to the point where I have to pay the "over-the-credit-limit-fees". I know this is done intentionally and very sneaky of them of how they find ways to charge you to line their pockets. I am interested in finding ways or steered to a right directions to fight these greedy mongers if Congress can't do their job.

    I had a fixed 4.9 and they just came in and took it away!! No missed or late payments. Always paid bill! They changed my interest rate to 14.99 and said they can and that I have to accept it!! Help Clark Howard. What are my rights. I am not the one NOT paying my bills
  • Scam artists at American Express late fee
    Ditto Clark's comments above and others commments below. On a recent statment, paid our account electronically, on time and in full as we do every month but Amex claims they received it a day late and charged a finance charge divided between two months. Got them to give us a credit for one of them but not the other. Asked to speak to a supervisor who had the nerve to tell me that it's a challenge for them because they have to carry so many costs, fees, etc. themselves as a business, blah, blah, blah. I laughed and said you've got to be kidding me! A customer like us is a dream and the reason they are in business. Without us using their card they don't have jobs!!

    Yesterday I received an amendment to my Bank of America credit card. According to the amendment, they are raising my interest from 9.9% to 25% and no reason was indicated. I have been paying my card on time and just recently transferred a balance to this card because of the low interest rate. I called the bank and they stated that if I was disputing the interest, I can pay the balance with the 9.9% interest rate but can not charge that card any longer otherwise the agreement falls through and my interest rate will be raised to 25%. I hope that by agreeing to pay my balance at the lower interest rate and not charging my account is not going to affect my credit score because I am working really hard on paying off all my cards. I just did not know that they can amend the cards from a fix interest rate to a variable.

    We all need to limit the use of these cards, but to me rule 1 is join a member-owned credit union and get your card from them. If that isn't possible, a small local bank is next best. NEVER possess a credit card issued by one of the huge multinational monstrosities. You will have far fewer problems.
  • Late fees
    I have always paid my bills ontime. This month, I received a late fee of $29.00 because the company said i was 1 day late. I sent my payment out on the tenth of the month, while not due till the 21st. They claim they received it on the 22nd. They would not remove this fee for me, even though since 1950, I have never made a late payment to anyone, ever.

    Since they would not remove this late fee charge (and I have always had zero balance, as my nature), I suggested that I would just cancel the card. The representative laughed in saying that this would really hurt my credit if I cancelled. Clark, if a cardmember wants to cancel a card, especially while in excellent standing, this should appear on their credit report as a good choice. I feel as if I have no rights for being an person with immaculate credit worthiness. Many times, the credit card company is at fault, and they need to be punished. I feel for others because they are being used in what can be termed, "legal lonesharking". The government needs to corral this immediately, for I feel this would be an immense stimulus package for many Americans.

    Meanwhile, i plan on attacking my credit card company. Do you have any suggestions/verbiage that I may use on my behalf. SOme industry terms and knowledgeable inside info would help my case, do you not agree?

    These people are so dispicable that I hope I live long enough to see them prosecuted to the full extent of the law. Something had better change or we will probably see smart people going to a cash only transaction and these people will find they are not needed in this society. I told one of these cc's who market themselves as helping people with poor credit establish good credit that if that was really their intent, they need to put a " mail by" date on their statement instead of a "due date." People who have to reply on the mail cannot predict with accuracy when that payment will be delivered - moreover, these people solicit customers from way across the US so unless they can pay electronically, they are at these thugs mercey. I could write a book but I would love to talk to you over the phone. Thanks for listening.
