Oct 04, 2007 -- WaMu tightening standards for mortgage brokers

Did you know that about two-thirds of all loans are not done by the lenders themselves? They're done instead by mortgage brokers. Mortgage brokers don't have the cash, but they're like the retailer who sells you a loan. Meanwhile, there's a new report out that says about half of all sub-prime mortgage holders could have qualified for good loans at good rates. So what happened? Some mortgage broker conned them into it a sub-prime loan. Washington Mutual has issued a new policy that requires brokers to tell people the truth about whether their interest rates will change, if they'll face a prepayment penalty and if the broker will receive kickbacks (aka bribes) from the deal. Whenever Clark talks to people who are in weirdo exotic mortgages, he always asks them if they knew beforehand that they'd have a prepayment penalty. You have to be sure that this is disclosed to you before the closing. WaMu is also going to call each borrower before the closing and verify that they aren't being ripped off by the broker.

The best way to protect yourself is to shop around for a mortgage. This is a huge field where many people are ethical, but there are some who engage in criminal behavior. Clark thinks two steps should be taken to help out: First, prepayment penalties should be banned. If you find out before closing that you'll be subjected to one, walk away from the negotiating table. That's what Clark did once when he was almost about to be hit with such a penalty. Second, the Department of Housing and Urban Development needs to develop a clear disclosure form to explain in plain English the details of a mortgage. Until they do it, there's a disclosure form that Clark really likes developed by The American Enterprise Institute.

    We decided to refinance since interest rates were so good. Well we went with bankrate.com since they were recommended by this web site. We feel that the loan officer (Steve) handled us poorly, he did not have an appraiser come to the home to evaluate it he just did a computer search of what houses in the area are going for. We feel if it was so easy and cost nothing to run this search he should have done that first before making another inquiry on our credit report. Then he said because of a foreclosure in the area our home lost $50,000 value. Unless we bring $25,000 to the table we can't refi!!! Wow , that is amazing. We can't believe that our home lost so much value.I think that he may have us confused with a subdivision that is next store to us because we are in a $225,000 and better subdivision. The home address he called off as being forclosed was not in our neighborhood. We are just disapointed because we feel this guy has taken advantage of Mr. Howard's good name. He (Steve)should be trained properly in this trade before venturing into working with personal information.

    I have been a Mortgage Broker for over ten years. My business has always been dealing with conforming and Govt loans, if I could not fit a borrower into a quaslity loan with a quality leander (one I would put my kids into) I will work with the borrower to fix the problem so at some point in the future they would qualify. I know in the past there were brokers that would just have put them into a subprime loan and go look for the next loan with no regards for the customers well fair. But thankful to say most of them are out of buisiness. With the colapse of the subprime lenders also went the colapse of the subprime broker. Those of us who have been in the business for many years and are still in business after all that has happened and most of all, truely are concerned about the well being of our customers would appreciate not being lumped into the same catagory as those who are less ethical. Rememeber, there are good and bad business practices in all industries, but a few bad apples dont spoil the whole bunch. Thank you for allowing me to be a voice for all of us that DO THE RIGHT THING in the shadow of those who didnt.
