Aug 20, 2007 -- Try virtual picketing to resolve home builder issues

How should you deal with a builder who doesn't honor the terms of your warranty after you close on your home? For the past 15 years, Clark has been advising people to picket the builder at their developments. You used to have to call your jurisdiction to find out how to go about picketing, and make sure that you never said slanderous things about the builder's character. But today instead of physically picketing, people take their ire online. Business Week did a report on homeowners who have set up gripe websites. Some builders have even fought back by trying to put clauses in their contracts that aim to silence you if you do business with them. That's an infringement of free speech. A builder who is afraid of the truth is not someone you want as a business partner.

Clark knows that building a house is difficult and involves a lot of micro-management with all the day laborers and subcontractors. He advises people not to close on their home until all the contractual items are complete. If you're getting pressure to close anyway, consider hiring a lawyer to withhold money in escrow to cover any outstanding issues. This practice, known as retainage, is a standard set at 10 percent in the commercial market. Just remember that once a builder completes your house, you're yesterday's news. The only reason they have to care about you is their reputation. So consider taking your battle online if need be.

    MOuntain House California a new city is located 10 miles from Tracy California. It is in total isolation. NO GROCERY STORE-DRUG STORE-SERVICE STATION!
    Those are the bare minimum of servival for existing!
    Unforsene occurrances happen all the time. It is unconscienable to drive 10 miles to Tracy California to the SAFEWAY or WALGREENS to do business. Oh yes, if you run out of qas or have a flat tire your looking at a 10 mile walk. Is the FLINT STONE AGE a new way of living? I hope the builders have more compassion than that!

He asks buyers to increase the purchase price on homes and later provides cash kickbacks so that the home values in the neighborhood are driven up. All homeowners are angry, what do we do??

    We are living in a jungle literally. Sivica Homes Builders and GW & Associates both refuse to cut down this mess. We are living in danger because we are bug infested, snakes, poison ivy and illegal dumping is getting all out of control. We cannot even take walks around our neighborhood afraid of what might be lurking in the jungle. I have called Sivica, GW & Associates, Clayton County Code Enforcement, every news channel and no one will help us. Can anyone give us any ideas on what to do next? We want our community to have that nice manicured look like some other neighborhoods.   • Builder lack of commitment
    I never thought that I would have to deal with this type of situation. A few weeks after moving into a new neighborhood (Bramlett Meadows-Paulding Co.) a number of neighbors informed us of different discrepancies that the builder left undone. Before long we joined them. We have verbally as well as by written statement informed both the builder and his foreman. As a matter fact the agent too. It's two years and still no resolution. Well Mr. Kerry Brand of BrandHomes of Atlanta we will see how far that "Builder of the Year 2003" award gets you in court.
