Jul 27, 2007 -- Banks purposely ripping you off with overdraft fees
Some bank accounts charge you a fee just to check your account. A call years ago spoke of getting hit with an overdraft fee, even though they knew they had a good balance; was this a clerical error? No, it's a new strategy in banking that tricks people into overdrafting their accounts so that the bank can charge them. Banks used to reject transactions that they knew would cause an overdraft. Not anymore. Many banks now purposely approve transactions that they know will overdraw your account. According to Congressional hearings, banks made $17.5 billion dollars due to this! Even worse, many banks use software programs to see what will cause the most bounced checks, or give you false balance reports at ATMs so that you you'll overdraw! Clark thinks a bank should at the very least inform you that they're going to try to rip you off by approving transactions that will cause overdraft fees. You now need to take additional steps to monitor your account as closely as possible to avoid getting ripped off.

Like many of you I'm sick & tired of pleading with banks and their unfair practices.
So I have a question: What would cost the bank the most money...
a) returning $30.00+ in imorally gotten fees or...
b) $1,000's in window relacements that have been mysteriously busted after hours?
Not advocating such actions, but was just curious at the idea???

NEED HELP PLEASE!!! This past thursday i went to a restaurant/sportsbar and purchased a couple of drinks and desert. The total was 12.00 (includiing tip) I had my debit card placed on hold (which makes me wonder about the establishment holding a certain amount on the card BS which was not explained to me by the waitress and I was not aware) They took a flat charge of 50.00 bucks out my account!!! Which caused me not to cover the 2 charges I made after we left. (Gas/micellaneous) Wachovia turns around and hits me with 5 overdraft charges totalling 175 bucks! Its like I got hit for penalties for the purchases i made that night plus a couple of days before from the bills I paid (that only comes off hold until today so it gets caught in the mix) I went back and forth with the bank they only gave me a half of it back and told me that it was just a COURTESY. They also said that there are only two types of refunds, bank error or courtesy. Well I dont think this is courtesy, its either an error on somebody else's part or ROBBERY!! Help!!
too much over draft fee from boa
my bank account with bank of america was charge with 11 over draft fees when i used my dedt car the money was in there because it was taken out right away for some reason the put the money back into the account and cash a large cheque and the charge me a fee for all the stuff i purchase using dedt if the money was not in there when i used the debt it would not have gone through in the first place i think this is highway robbery what can i do to recover this money this has set me back financially really bad thank you
Bank of America Rip Off Overdraft Fees
I have two accounts with Bank of America.I am currently unemployed and have been for 1 year 3 months so every penny counts. I had two auto pays, one on a credit account, the other mortgage they are both with B of A. I called and cancelled both of them well before the date to pay was due. Well, the associates in both areas failed to cancel and it caused over $800 in ovedrafts. It was a nightmare trying to get them to reverse all of the fees. It took me two weeks and a bank mgr. to have it corrected. As a result of all of this, it caused $300 in overdraft fees on my other account. I have been working trying to get these fees reversed for a week now. So far, they tell me no. I am having a mgr. work on this one for me. I had the funds to cover all the pending items but then an insurance payment came through, they paid it and caused all the other pending items to be overdrawn. Also, as a result of the fiasco on my other account, I could not make a money transfer to prevent this. Their practices in my opinion are illegal, but they still get away with it. I now don't keep much money in the account. I pay all my bills with a money order instead of paying online. They are ripping us off and I think it is time that they are brought to court and face the music.

Yes, they do in fact post by amount (largest first), instead of order of arrival. BOA told me they do this as a courtesy, so the larger amounts (usually mortgage or car payments) will go through, leaving the more numerous smaller ones to become overdrawn. After confronting them with this information and the amount of dissatisfied customers and referencing Clark's articles on this, evasion by the BOA CSR, avoided the question by saying its BOA policy and there's nothing she can do followed by your satisfaction is most important to us, is there anything else we can assist you? I check a nearby credit union, they do not process transactions this way.
WAMU --> Chase- anyone know a better TX bank?
Since WAMU was bought by Chase I have been hit hard with overdraft fees, even after checking my account every day and not seeing any potential for an overdraft. The bank waits to clear my deposit (even auto deposits from work) until after I am "overdrawn" because of the delay. does anyone know a fair bank in the Houston TX area?
BB&T Overdraft of over $ 800
BB&T has done it again. I checked my 87 y.o. father's account today and they have charges on his check card that posted August 17 & 18 that should have posted a week ago or more. So because my dad thought he had money in his account - he was using the card. I am so upset - he only gets $ 2,000 a month from his retirement benefits so when his check hits BB&T they will take over $ 800 of his money (fixed income). I am calling Washington, DC (he's a retired federal employee) and have his checks directed to our credit union. How does my father's taking his grandson to McDonald's for a burger that's $ 5.65 end up costing $40.65 - there are lots of charges on here like this. Please help with advice.
Wachovia is in the nasty mix
As Amber reported in May, WACHOVIA just informed me that the $245 they charged us for NSF happened because they put through the largest amounts first "because they assume those are the most important." This is exactly what the bank told me.
Living on the low dollar amount we've been forced to with my husband's new job (thankful he even has one), we nickel and dime everything to make sure we don't get hit. Over the weekend, we worked our way down from what we had knowing that at the end of it all, we had under $2 in our account. But we had groceries for our family, and a tank of gas. Not getting paid until that following Friday, we knew we'd go into OD when we knowlingly took out $60 for gas. That would be the only NSF charge. However, being that the other charges were made over the weekend (so the bank didn't immediately deduct them even though our minds knew it was gone), they hit us with the $60 first, which was the last thing we took out causing the OD, and in turn, that left us without enough to pay the things we had nickel and dimed to make it all work out.
The sick thing? We're busting our rump to make this all work believing we're being taught new lessons in spending, and just to have the banks implement these DISHONEST tactics and have us lose money that was supposed to carry us for the next two weeks....oh, and be so gracious as to let me know "it's the way it's been done (largest amount out first) for 15 years, and we can replace 20%...does that help???"
A BIG FAT NO!!! We're burying our money in the backyard...what's this world coming to? Seriously???

Old National Bank.
I'm currently looking for employment, and I keep my account -very- tight ran; I held a positive balance after a few payments, I've never overdrawn in my life.. and I am hit with an unexplained additional charge from the bank itself just barely going over the amount I had in - thus placing me in the negatives.
I was then hit 3 days later with an overdraw fee, and hit for $8 every single day since. By the time I was notified [a week and a half later], I owed them over $100, for an initially -1.37 balance they themselves created. All calls in to try and rectify or manage the situation have fallen on deaf ears.
Completely absurd.
NSF Charges from Bank of America
Over the past few years I have been charged over $3000.00 in NSF Charges for the same practice. I did not know about the class action suit was wondering if to late to join.
Banker Steve's "fine print"
Banker Steve, can you please tell me where in the fine print, on any of your brochures or paperwork, it advises the customer that bank of america uses software programs to run algorithms which will profit the bank most, against customer withdraws and overdrafts? If you say they don't do that, you're a liar, because I helped implement the software for Bank of America, which is why I was fired when exposing how it was illegal if the bank was not advising anyone of this. Thus the recent class action lawsuits against Bank of America which have been one by those suing them. So.....your answer please?
Some Credit Unions Doing The Same...
After having problems with a major bank, I switched to a local credit union. I recently made four purchases using my debit card. According to their online banking website, two other purchases had already cleared, as well as a deposit. I had enough money to clear all of the purchases. The next morning I looked at the website again. It now showed the first two purchases and the deposit as "pending". The four newer purchases had cleared, causing four NSF charges. Later that day, the other two purchases caused NSF charges. The next day the deposit cleared. (the deposit was cash, made in the bank) This caused me over $450 in fees and is still unresolved.

Banker Steve: Speaking as a recovering banker, I have to say that your arguments are pathetic. I left your occupation because of the sick "logic" you guys purvey. Using typical banker's logic, you say that it is the victim's fault he was ripped off because he failed to protect himself adequately against your predations.
You charge $25 and up for NSF check returns, despite the fact that the cost to the bank runs around 55 cents. Sure, it is irresponsible for people to allow checks to bounce and/or overdraw their accounts. But the bank's behavior is legalized thievery. Your smug attitude that it is the fault of the robbed, not the robber, is disgusting.
The whole history of bankers, beginning with goldsmiths who loaned out gold they were entrusted to keep and protect, has been a long chain of dishonest practices that were eventually legitimized by corrupted legislatures. Today is no different.
I agree that people should exercise proper care over their deposits, if only to protect themselves from pickpockets like you.

Banker Steve, you and your industry are crooks. On occasion I have to use the system but the result is thievery. The methods used to process transactions in order to charge overdraft is dishonest. If you used time line dating fees would be justified. But the practice of selective ordering which results in excessive charges is revealing the true nature of the industry, Greed. From what I've read here, it seems as if everyone just tossed the brochures that were given to them to read regarding their accounts at their bank. Do we honestly live in a society where not a single person is a grown up and takes responsibility for their actions? Most people would turn around and walk out of a bank if they read the deposit account agreement that is given to them before they sign on the line to open it up. YOU are responsible for your account. Why is it the bank's fault if you spend more money than you actually have? As for the line about Clark thinking a bank should at the very least inform you of these things.......they do. But who wants to read words in a brochure and who wants to keep track of things by writing them down....that just makes too much sense. I guess these are the same people that have these insane mortgages because of the "evil" banks. These people failed epically once again to take a second and read....that is all we ask, for you to read the things we give to you. I really wish that everyone would grow up about overdraft fees and these mean banks that are preying on people. I've made mistakes in the past and have received a few of these charges myself. Do I feel like I'm being ripped off? No, because I read everything that was given to me and I understand that if I make a mistake, I'm held responsible like an adult should be. It is like speeding, being pulled over, and getting a ticket. Do you honestly think the judge is going to believe you when you say, "No one ever TOLD me that I would have to pay a fine for speeding." That is right. No one at the DMV ever TELLS a person that is getting their driver's license that they shouldn't speed because they will have to pay a fine. They give you a booklet of the laws of the road and expect you to be an adult and read it and ask questions if you have any. I think its funny that people will spend more time complaining about overdraft fees than actually trying to self educating and educating others on how to be responsible. An entire thread with nothing but people complaining that its outrageous for a bank to charge such high fees. I find it outrageous that you people run blindly into the real world always expecting there to be someone there to forgive you of some wrongdoing that you created yourself. I guess a good portion of you have tasted what the real world is about, through these fees. Its about responsibility. Quite frankly, I'm scared. Mainly because most of the people that have posted things about "evil" banks, have children.

BB&T are not any better. They charged me an overdraft fee on a debit purchase the day I made and it and then charged me another over draft fee the day the debit purchase actually posted to my account. I miscalculated my account by $5 and it cost me $75. All over draft fees are is legalized robbery. I switched to First National Bank and have not had any problems at all.
DONE with SunTrust!
I switched to a credit union last week after banking with Suntrust for almost 10 years. Never again will I EVER bank with any type of big bank. While we are struggling and making it day and punished with paying outrageous over drafting fees and all the other fine print fees, the Bank CEOs' are living it up at our expense. I refuse to give them another dime!
I thought my credit would prevent me from getting in a credit union but to my surprise they only wanted to see if I had a negative balance with any other banks.

Bank of America is a rip-off! They charge you too much money for everything. And they take advantage of people that already have credit issues thinking we can't go anywhere else. As of this month I am withdrawing all of my direct deposits.

Bank of America changes the order of debit charges to your account. They charge the larger amounts first hoping that the smaller amounts will post NSF; thereby charging fees for each smaller transaction
old national stole my money
My husband went to a local jewelry store to buy me a watch for graduation,he only had $85 cash so told them to take the rest with his old national debit card,the sale assistant mistakenly took the whole $102 from the card but upon realising her mistake ,refunded the money to our account 2 minutes later. Old national bank then charged us $105 for being overdrawn and say it is the jewelers fault and have to have a comittee meeting to decide if they will give us our money back. The money came out of the account immediatley but the refund took 8 hours ,they admit its not our fault ,we did nothing wrong but they still wont give the charges back. Basically $105 for 2 minutes ,this surely is wrong and unlawful ,we dont know what to do apart from close our accounts and look else where . Any advice would be appreciated
where do we make deposits?
I have banked with Regions for years. Thats going to change! Regions used to let you make deposits at an ATM, now they have stoped that. So, I was in a hurry the other day and droped my deposit in the night deposit at 8:30 am on a friday. Thinking that my funds would post that night. WRONG! Regions says any deposits made after 8:00 am are not even processed until the next business day! They charged me 2 overdraft fees, and caused a great deal of problems for me. You would think that you make a deposit before the bank opens and they would process it that day, but I guess not, Thats too simple! They have gotten fat and happy and are looking for ANY TECHNICALITY TO RIP US OFF! i WORK FROM 7 AM TILL 7PM, where are we supposed to make a deposit? It's like we are b eing punished for NOT coming into the bank! But thats ok, they have got me for the last time! Dont let Regions get you too!
NSF Banking Rip-Off
Old National Bank in Indiana. I buy food and gas with a black balance. They deduct these pending debits off my running balance showing my decreased balance at the time. 2-3 days later I get my automatic deposit along with 1 check that was large and came in the same time the auto did. That larger check technically did not clear and blew out my 4 pending debits that showed I had the funds already days before. I have turned OLD NATIONAL BANK into the OCC for holding older debits that I had the funds in the account for originally. Why can't we get a class action lawsuit running against these theives?
Switching from Bank of America to a credit union
Being a student and going through a divorce led to 17 overdraft charges on my Bank of America check card. I ended up with $595.00 in overdraft fees so now I'm just closing out my account and using a credit union. Since most of the charges were at fast food most were around 3 to 4 dollars. Now I have just decided to bag brown my lunch and stop eating out as a way of protesting this mess. Even though this is expensive and painful I will come out ahead by eating healthier, losing weight and supporting credit unions. I urge all Americans to drop the bank and use credit unions.

Bank of America is trying to switch around my debits in order to charge me overdraft fees. I keep a check register and also refer to the online banking tool to keep my balances in order. I just don't see how they can legally get away with it. I think consumers need to start fighting back. I, too, am also checking into using my credit union for banking services.

Regions Bank, charge me $875.00 in NSF fees in one week, they put an electronic deposit on pending status to rack up small debit charges. After 3 days the bank did it again with a cash deposit.

My husband and my 16 year old daughter have both been through this with U.S. Bank, it has has been so hard to try and counteract these overdrafts and fees that they are both going to close their accounts and go to a credit union.
Sick to Stomach
I'm tired of banks justifying these obscene charges. I get frustrated but at the same time, feel bad for the poor tellers and branch managers who don't always know or care how stupid they sound sometimes TRYING to explain their banks reasoning to you.
I keep a check register, and recently overdrafted because a christmas gift from my grandmother was returned... it was incorrectly dated. I didnt find this out until it was too late (i.e. after the over draft when I received the check in the mail) I overdrafted 3X because of that. I deposited MORE THAN ENOUGH CASH to cover the over drafts and any additional charges that had not hit the bank. We were charged over draft fees 6 more times. Literally, my account was at a positive balance near $100 and THEN it went into 6 overdraft charges, and THEN into the actual purchases. Because (sarcasm) we all know debits are always taken from the account first, even if they come AFTER a cash deposit the same day, because that's the right way to do business... (end sarcasm).
I'm going to do what I should've done a long time ago and open an account at a local credit union!
M&I Bank
M&I Bank in Wisconisn uses the same tactic. They are horrible and I am closing my account. They use the pending trick, then reshuffle the deposits and payments to create overdraft fees. Beware.
Wachovia & Regions
Wachovia holds payroll checks for 1 - 3 days before considering them as a credit. The bank immediately cashes checks against your account and hopes for an overdraft to happen while they hold your deposit. Regions took my cash deposit and listed it as "pending". During this time they pay checks written against this deposit. The next day, the cash deposit disappears - not pending and not credit - just gone. All checks comming to the bank might incur an overdraft. On the third or fourth day, the cash deposit reappears as a credit. Here's another example. If you deposit a payroll check and immediately decide you want some back in cash - you can't have it for three days! But, if you cash your payroll check and then make a deposit from your cash - you're OK. Seems dishonest to me but Regions says their new little green sign in the bank lobby makes everything legal.
Transaction Register
Maybe if you people keep a transacton register you will know what your balance is at any given time. You should take the balance the bank shows and minus out the transactions that have not cleared. People rely too much on the internet and telephone banking. What ever happened to the old way of banking?

I wrote a check and post dated it for the following day and asked the guy to whom I wrote the check to wait until the next day to cash the check(This was about 3p.m.). I went to Walmart (around noon, a few hours prior to writing the check) and made a $3.27 debit purchase. When I got home I checked my balance and the transaction from Walmart had cleared. The next day, the check had been posted (the guy went directly to the bank and cashed the check, urgh! Anyways, back to my story. Bank of America posted the check prior to my $3.27 transaction throwing my account into overdraft and charging me two overdraft fees instead of the one I should have incurred. When I contacted the bank, they told me they pay higher to lower debits. I told them I understood that, but the transaction for $3.27 had already been posted to my account before the check had even hit the bank. They also told me that post dating a check was useless because it was a legal document and the bank could cash it when they wanted. If it is a legal document, isn't is good for the date in which it is written? Anways, just wanted to give my two cents worth. I think it is wrong they switched the check and the $3.27 transaction therefore having me have two overdraft fees. The transaction from Walmart had cleared then they did the old swith-a-roo to get another overdraft fee. Bad Business!

My grandmother uses Bank of America and she went in to the bank at 9 am to deposit CASH and the lady said it wouldnt post for 48 hours!! I remember the days when cash posted immediatly and checks dep before 2 cleared that day! Also had a problem with Best Bank, the charged me an overdraft fee and I didnt have the money to pay it back immediatly and now i owe them over $600. they wont close my account because I owe them money and every week that my account is overdrawn they charge another $32 overdraft fee.

my wife had an account with woodforest bank that had been charged off. she had a small payroll check in the amount of 199.48 that she wanted to cash at woodforest bank(husband has account at same bank) to make a long story short the bank kept her check because as they put it it all has to be applied to recovery
Overdraft Fee
I had an automatic payment due to come out of my account on Thurs. July 24. In the morning of the day the payment was due, I took one of my paychecks and a $100 personal check written on the same bank, National City. I deposited it. I should have had roughly $30 left in my acct after the pymt cleared. The bank only credited part of paycheck. (held funds till the following day) in order to charge me $102 in overdraft fees. The bank mgr would not reverse the charges, not that he was man enough to tell me that at the time. I had to check my acct online to see if they would grace me with my hard-earned money. They have not. Does anyone know of a bank that does not steal from their customers?
Over draft fees from checks
My daughter made some checks out to pay bills it turns out she has been in an over draft for about 2 weeks and everytime she called her back they never told her and the amount being said was not the correct now she has over 200 dollars in over draft fees the bank refuses to work with her before this she never had a problem

We had an excellant rapport with our Georgia State bank. We knew every minute what we had and did not have in our account. They have sold to RBC bank. In the last 4 weeks they have bounced every single transaction that has passed through thier bank resulting in close to $200 in overdraft and re-entry fees.We were not perfect at our old bank with maybe 1 bounced check a year, but this is ridiculous! PEOPLE BEWARE! We are not the only ones they are doing this to, we personally know 8 people that have left this bank for them doing this to them. They are holding checks, holding deposits etc. DO NOT USE RBC BANK!
bank rip off
I made a deposit to my checking account. The deposit included a check I wrote and a check my husband wrote. Both signers on the account and both checks were from local banks. The deposit slip said credit would be on the next business day. I then mailed a check for my mortgage from the account to Texas.
The bank charged me an overdraft fee of $35.00. They said the check I wrote (after I made the deposit)and mailed to Texas cleared before my account was credited with the deposit I made.
