Aug 22, 2005 -- Debt collectors violate the law by taking your money

Clark has had dozens of calls about collectors and collection agents pressuring people into paying money for past debts. Often times, people don’t even owe the money. But the collector has gone to a bank and basically bought debt that someone owed from the 80s. Typically, the debt has been wiped out during bankruptcy, but banks sell the debt anyway. Then, the collector looks up the name in a database, calls the person listed and starts screaming at him or her to pay this debt. Anyone with the same name could be contacted. Yet, some people get so intimated by the collector that they pay. One company Clark has talked about before is NCO. The company has been going after people who don’t owe any money after buying a bunch of debt from Chase Bank. What most people don’t know is that it’s illegal to try to collect a debt in bankruptcy. So, if you get a call from NCO, know that it is a scavenger organization that has been fined numerous times for violating the law. However, if you get a letter in the mail, you have to dispute the claim. It sounds ridiculous, but you MUST respond in writing and tell the organization that the debt is not yours. Otherwise, it becomes your debt automatically. And, even if you do owe a debt, never give your banking information – or a postdated check - to a collector.

  • NCO- Debt is Legit
    I just got a letter and phone call from NCO. Amount is $50 and I do owe it. It was an account I forgot about being paid by and expired card. My fault and I want to pay the amount. (I would rather pay it to the original company, not NCO but too late for that)

    Based on NCOs rep I don't want to give them money without conditions. I have heard I can notify them in wirting that I will pay as long as they state in writing that they will remove the negative from my record. Anybody ever done this or know if this is accurate?

    I have the money and can easily pay it. I feel it is my obligation to pay it. I just feel I can/should get a clean record out of it if I do.

    It get a recorded message with a number to call and a code to reference. They say in the message that they "legally" have to inform me this is calling about a debt (we don't believe we have any) and that any information used in any discussions can be used in trying to collect. My Question: How do I get the phone calls to stop??? Should I call the number??? Help!

    I just received 2 separate and different notices for NCO (with different account numbers AND the exact same amount to the penny !). Knowing that I owe nothing, I tried contacting the 1-800 number, and no answer. Seeing the North Carolina insurance license on the form, I contacted the NC Dept of Insurance. The bread crumbs led me to a law firm in Louisiana (504-828-3700). They were very squirmy, and asked me to call back. This is very bizarre and all feels rather shady.

    I tried ignoring NCO because I knew I had no debt, but got to the point where I just wanted to make the constant phone calls stop. When I picked up the call today, it was actually a human being and not a recorded message or a disconnect. It turns out the person they are trying to reach is not me! He told me they would take my phone number off the list, but I don't feel very confident that will happen soon. If the calls continue, I will report them to the Federal Trade Commission and PA's Attorney General's Office.

    I just started receiving MULTIPLE calls per day from NCO on my cell phone. I picked up a few times but it just disconnects. Only once did I get a message to call a number, but they didn't even give me a code. My credit report is clean so I don't know why they're calling.

    Yes for some reason we have been getting these calls as well. I have not received anything in writing and have started to review our credit report at least quarterly.

    We are receiving phone calls daily from this group. However, it's not a person calling but instead a message saying we must call this specific number and enter a code to get more information. Based on Clark's note above, I'm assuming I shouldn't / don't have to call them. Is anyone getting this kind of msg from NCO?
